FOR THE APPROVAL OF SPECIAL REVIEW FOR OUTDOOR DINING IN REQUIRED
OPEN SPACE FOR TAKAH SUSHI RESTAURANT LOCATED AT 420 EAST HYMAN
AVENUE (LOT O BLOCK 88 CITY AND TOWNSITE OF ASPEN)

WHEREAS, Section 24-3-101 of the Aspen Municipal Code allows
required open space to be used for commercial restaurant activity
pursuant to special review by the Planning and Zoning Commission;
and
WHEREAS, Takah Sushi Restaurant submitted an application for
special review to the Planning Office to place four three-person
tables in the open space between the 414 and 420 East Hyman
buildings; and
WHEREAS, referral comments were received from Engineering
Department, the Historic Preservation Committee, and the Fire
Marshal; and
WHEREAS, the Commercial Core and Lodging Commission declined
to review this request because the location is on private property,
not on the public mall; and
WHEREAS, upon consideration of the referral comments, the
application, and Section 24-7-404 of the Municipal Code, the
Planning Office recommended approval of the special review request
with conditions; and
WHEREAS, the Planning and Zoning Commission reviewed the
request and the Planning Office recommendation and voted to approve
the special review by a 4-0 vote at a regular meeting on June 7,
1994.
NOW, THEREFORE BE IT RESOLVED by the Comm~sslon that it
approves a special review for outdoor dining for the Takah Sushi
Restaurant with the following conditions:
1. The use of the open space is for outdoor dining in
approximately 120 square feet with 4 three-person tables.
2. The outdoor patio use shall begin on Memorial Day weekend
and end October 1 which is consistent with other outdoor
dining uses on the pedestrian malls.
3. This approval may run with the restaurant until such time
that the patio use is expanded which shall require an
amendment to this approval or the property owners terminate
the use of this area for outdoor dining purposes.
4. The fencing shall be cast iron and a gate is necessary to
control access.
5. Ail representations made in the application or by the
applicant before the Planning and Zoning Commission shall be
adhered to during development.
