HomeMy WebLinkAboutresolution.apz.020-94 RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION FOR THE APPROVAL OF GMQS EXEMPTION FOR A CHANGE IN USE AND CONDITIONAL USE FOR A PILATES FITNESS STUDIO LOCATED IN A SERVICE/COMMERCIAL/INDUSTRIAL (SCI) ZONE AT 530 E. BLEEKER STREET Resolution NO. 94-~ WHEREAS, the SCI zone district allows as conditional uses dance studio and martial arts studio and Section 24-7-304 establishes the criteria for conditional use review; and WHEREAS, the Planning office has an established policy which interprets fitness businesses the same as dance studio or martial arts studio; and WHEREAS, a change in use from residential to commercial may be approved by the Contmission as an exemption from Growth Management competition pursuant to the criteria in Section 24-8- 104 B.l.b.; and WHEREAS, BCS properties submitted an application to convert a dwelling unit in the multi-use building at 530 E. Bleeker to a Pilates-based fitness studio while intending to keep a portion of the space as a residence for the fitness trainer; and WHEREAS, the application was reviewed by the Housing office for referral comment; and WHEREAS, the Planning office reviewed the application and the referral comments and recommended approval of the change-in-use and conditional use with conditions; and WHEREAS, in consideration of the application, referral comments and Planning office recommendation, the Planning and Zoning Commission voted 4-0 to approve the GMQS exemption and conditional use with conditions at a public hearing on January 18, 1994. NOW, THEREFORE BE IT RESOLVED by the Comm%ssion that it approves the Growth Management exemption for a change-in-use from residential to commercial use, and a conditional use for a Pilates- based fitness studio in an SCI zone district for the conversion of a residential unit to a commercial/residential unit located at the BCS property located at 530 E. Bleeker Street with the following conditions: 1. This change-in-use only applies to one 750 s.f. residential dwelling unit at 530 E. Bleeker Street. 2. The dwelling unit shall be maintained in the Pilates space. If the dwelling unit is eliminated the applicant shall be subject to the Housing Replacement program requirements (Ordinance 1, 1990). 3. The applicant shall adhere to all representations made in the application and at the public hearing. 4. The conditional use approval is for a Pilates-based fitness studio only. Any other service/commercial/industrial venture, in this space, shall require an amendment to this conditional use. 5. Prior to the issuance of any building or demolition permits and/or a business license, the applicant shall submit a floor plan to the Planning Office showing the four residential units and indicate which unit shall be used as the Pilates-based fitness studio. ~PPROVED by the Commission at its regular meeting on January 18, 1994.
