HomeMy WebLinkAboutresolution.apz.024-94RESOLUTION OF THE ASPEN PLaitING ~ ZONINO COI~ISSION GRANTING 8040 GREENLINE APPROVAL AND SPECIAL REVIEW APPROVAL FOR OPEN SPACE ~ND PARKING FOR THE 50 UNIT WILLIAMS RANCH DEVELOPMENT WHICH IS LOCATED IN SECTION 7, TOWNSHIP 10 SOUTH~ RANGE 84 NEST OF THE STH P.M. Resolution No. 94-t~ WHERE~S, the Planning office received an application from the Smuggler Consolidated Mines Corp., represented by Tom Stevens and Gary Wright, for Final PUD/Development review for the Williams Ranch Project which includes 35 fully deed restricted dwelling units and 15 free market lots to be located in the Affordable Housing zone district; and WHEREAS, the 12.7 acre parcel is currently located within Pitkin County, it will need to be annexed into the city of Aspen; and WHEREAS, pursuant to Section 24-7-503 of the Aspen Land Use Regulations 8040 Greenline approval may be approved by the Planning and Zoning Commission as development in an environmentally sensitive area in conformance with the requirements of this Section; and WHEREAS, pursuant to Section 24-5-206.2 of the Aspen Land Use Regulations the open space and parking requirements for AH zone district projects require Special Review approval from the Planning and Zoning Commission; and WHEREAS, the Planning and Zoning Commission considered the applicant's request at a public hearing on September 13, 1994, at which time the Commission voted 4-0 recommending approval of the applicant's Final Development Plan with conditions to city Council. The Planning and Zoning Commission also granted 8040 Greenline Review and Special Review approvals to the applicant at this meeting. NOW, THEREFORE BE IT RESOLVED by the Planning and Zoning Commission that the Williams Ranch Subdivision/PUD request for 8040 Greenline Review and Special Review for open space and parking is approved, subject to the following conditions: 1. Lot 15 is limited to eighteen feet in height (plus five feet to the mid-point), as calculated by Pitkin County's Land Use Code. Ail other lots are subject to the 25 foot height requirement of the city of Aspen, and are calculated using Pitkin County's definition for height. 2. The floor area for the free market parcels shall be 80% of what is permitted in the AH zone district and shall be Se 7e restricted to the designated building envelopes on the Final Plat. Any lot owner proposing to build more than 80% of the permitted floor area is subject to full 8040 Greenline Review by the Planning and Zoning commission. Lots 1 15 shall have an engineer evaluate the site conditions to recommend foundation design at building permit review. A licensed engineer shall submit a report addressing the foundation design for the affordable housing units, prior to the issuance of any building permits. Building envelopes on the free market lots shall contain all development and disturbance proposed for those lots. Natural vegetation shall be maintained outside the designated building envelopes. This condition shall be noted on the Final Plat. Construction for Lots 1 - 15 shall take place without laid back slope grading techniques to reduce their negative visual appearance. Retention shall be kept as natural looking as possible. The applicant shall provide a public trail adjacent to the Salvation Ditch as it crosses the private open space parcel. The applicant shall provide two parking spaces per fully deed restricted unit, one parking space per bedroom for the free market units, and eight off-street guest parking spaces throughout the project.
