HomeMy WebLinkAboutresolution.apz.028-94 RESOLUTION OF THE ASPEN PLANNING AND ~ON~NG COMMISSION FOR THE APPROVAL OF GM~S EXEMPTION FOR ~ CHANGE ~N USE FROM COMMERCIAL AREA TO LODGE ROOMS AT THE MOUNTAIN CHALET LODGE LOCATED AT 333 E. DUR~NT STREET Resolution No. 94-.7~ WHEREAS, a change in use from commercial area to lodge accommodations may be approved by the Commission as an exemption from Growth Management competition pursuant to the criteria in Section 24-8-104 B.l.b.; and WHEREAS, the Mountain Chalet Lodge submitted an application to convert 1,566 s.f. of commercial restaurant space within the lodge to three rental guest rooms; and WHEREAS, the Planning office reviewed the application and recommended approval of the change-in-use with one condition; and WHEREAS, in consideration of the application and the Planning office recommendation, the Planning and Zoning Commission voted 6- 0 to approve the GMQS exemption for the change in use with one condition at regular public meeting on September 20, 1994. NOW, THEREFORE BE IT RESOLVED by the Commission that it approves the Growth Management exemption for a change in use from commercial use to lodge use for the conversion of 1,566 s.f. of commercial restaurant space (the former Lauretta's restaurant} to three lodge rooms in the garden level of the Mountain Chalet Lodge located at 333 E. Durant Street with the following condition: All material representations made by the applicant in the application and during public meetings with the Planning and Zoning Commission shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions.
