HomeMy WebLinkAboutresolution.apz.032-94RESOLUTION OF THE ASPEN PLANNING AND ZONING COI,~ISSION GI~.NTING CONDITIONAL USE APPROVAL FOR THE CONVERSION OF A SINGLE F~fILY HOME INTO A DUPLEX IN THE R/I'IFA ZONE DISTRICT, ASPEN, COLOI~DO Resolution No. 94-_~ WHEREAS, the applicant, Maxwell and Elizabeth Aley, submitted an application for a conditional use review for the conversion of their single family home into a duplex; and WHEREAS, pursuant to Section 24-5-2061.1 of the Municipal Code, a duplex is a conditional use in the R/MFA zone district requiring a public hearing at the Planning and Zoning Commission; and to category 4 one unit of the duplex must be fully deed restricted guidelines or an accessory dwelling unit must be provided for each free market unit; and WHEREAS, the Aley's proposed to deed restrict dwelling unit being provided to category 4 guidelines; WHEREAS, the Aspen Planning and public hearing June 21, 1994; and WHEREAS, the Commission reviewed Zoning commission the second and held a conversion of the residence which was approximately 798 square WHEREAS, the Planning staff reviewed the application and recommended approval of the conditional use review; and WHEREAS, the Commission voted to approve the conditional use review with conditions of approval. NOW, THEREFORE, BE IT RESOLVED by the Commission that it does hereby grant a conditional use approval with the following conditions: 1. Prior to the issuance of a Certificate of Occupancy the the application for the Resolution No. 94-__ Page 2 applicant shall, upon approval of the deed restriction by the Housing Authority, record the deed restriction with the Pitkin County Clerk and Recorder's office with proof of recordation to the Planning Department. The deed restriction shall state that the unit meets the housing guidelines for category 4 units and shall be rented for periods of six months or longer. 2. Ail material representations made by the applicant in the application and during public meetings with the Planning and Zoning Commission shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions. 3. The applicant shall agree to join any future districts which may be formed for the purpose of improvements in the public right-of-way. improvement constructing 4. The dwelling unit shall comply with U.B.C. Chapter 35 sound attenuation requirements and shall be clearly identified as a separate dwelling unit on building plans. 5. Prior to the issuance of a certificate of occupancy, the Planning Department shall inspect the unit to determine compliance with the conditions of approval. 6. If the duplex is ever condominiumized a note on the plat and in the condominium documents shall state that the laundry room shall be shared between both units or an additional 69.5 square feet shall be added to the category 4 dwelling unit. 7. Prior to commencing work within the public right-of-way, the applicant shall consult the City Engineering Department for design considerations, city Parks Department for vegetation alterations including tree removal on private property, and shall obtain permits from the city Streets Department for any work or development within public rights-of-way.
