GRANTING CONDITIONAL USE APPROVAL FOR A
BANK TO BE LOCATED ON LOT I OF THE TRUEMAN SUBDIVISION
Resolution No. 95-~-~
WHERE~S, pursuant to Section 24-5-212 of the Aspen Land Use
Regulations, the Neighborhood Commercial zone district allows
"business and professional offices" subject to Conditional Use
review approval as described Section 24-7-304; and
WHEREAS, the Zoning Enforcement Officer made a formal
interpretation that a bank can be classified under the category of
"business and professional offices" and is therefore subject to
Conditional Use review; and
WHEREAS, the Planning Office received an application from the
Trueman Aspen Company and Pitkin County Bank, represented by Philip
Bloemsma, for a Conditional Use review for a satellite branch
office of the Pitkin County Bank to be located within an
approximately 800 sq.ft, space; and
WHEREAS, the Planning and Zoning Commission considered the
applicant's request at a duly noticed public hearing on February
21, 1995 at which time the Commission voted 6-0 to approve the
request with conditions.
NOW, THEREFORE BE IT RESOLVED by the Commission:
That the Conditional Use review for a satellite branch of Pitkin
County Bank to be located on Lot 1 of the Trueman Subdivision,
subject to the following conditions:
Ail material representations make by the applicant in the
application and during public meetings with the Planning and
Zoning Commission shall be adhered to and considered
conditions of approval, unless amended by other conditions.
Prior to issuance of a Certificate of Occupancy for the bank,
the applicant will provide a 12 foot wide handicapped parking
space adjacent to the fire lane, and to improve enforcement
of parking in the fire lane.
Prior to issuance of a Certificate of Occupancy for the bank,
the applicant shall remove or disguise the existing night-
drop depository.
APPROVED by the Commission at its regular meeting on February 21,
1995.
