/%ND SPECIAL REVIEW FOR REDUCTION IN REQUIRED TRASH ENCLOSURE) FOR
THE HOWLING WOLF CAFE, LOCATED AT 316 EAST HOPKINS AVENUE (LOT O,
BLOCK 80) TOWNSHIP AND CITY OF ASPEN
Resolution No. 95-~
WHEREAS, Two Schmucks, Inc. (dba Howling Wolf Cafe), submitted
an application for Special Review to allow for commercial use of
open space and a reduction in required trash enclosure space for
an existing restaurant; and
WHEREAS, the subject property is located in the CC Commercial
Core zone district; and
WHEREAS, Section 24-3-101 (definitions - open space) of the
Aspen Municipal Code allows the Planning Commission to approve
commercial use of required open space pursuant to Section 24-7-
404 A.3; and
WHEREAS, Section 24-5-209 D.6 the Aspen Land Use Code allows
the Commission to grant reduction of required utility/trash areas
pursuant to Section 24-7-404 A.3.; and
WHEREAS, upon review of the referral comments submitted by
the Engineering Department, the Planning Office recommended to the
Commission approval of the Special Reviews with conditions; and
WHEREAS, the Commission held a public meeting at their regular
meeting on July 11, 1995; and
WHEREAS, by a vote of 6-0 the Commission approved with
conditions the Special Reviews the use of Open Space for commercial
use and for a for reduction of on-site trash enclosure space; and
NOW, THEREFORE BE IT RESOLVED by the co~mission: that it does
hereby grant approval for Special Reviews for the use of open space
for commercial uses and the reduction of required trash enclosure
space, based on the following conditions of approval:
The approval is based on the new site plan submitted at the
Planning and Zoning Commission meeting indicating the location
and size of the trash enclosure which shall also include
recycling.
A concrete pad shall be poured to accommodate easy roll-off
of the trash enclosure.
3. The trash area shall be enclosed.

The trash area shall be increased if the reduced size becomes
problematic or the operation of the building changes
significantly to require increased trash storage needs.
Ail representations made in the application or by the
applicant at the Planning and Zoning Commission meeting shall
be adhered top during development.

1995.
