DENYING THE SHADOW MOUNTAIN AFFORDABLE HOUSING PROJECT
SUBDIVISION/PUD CONCEPTUAL SUBMISSION, GMQS EXEMPTION,
SPECIAL REVIEW, 8040 GREENLINE REVIEW AND REZONING
TO AFFORDABLE HOUSING

WHEREAS, West Hopkins Partners LLC. and Craig Glendenning submitted an application
for the development of ten deed restricted units and four free market parcels on an approximately 1.26
acre parcel. This parcel is located on West Hopkins Avenue at S. 5th Street at the base and side of
Shadow Mountain and is about 20% within the City limits; and
WHEREAS, the Applicant was seeking to annex the parcel into the City, obtain
subdivision/PUD conceptual approval, GMQS exemption, special review, 8040 greenline review, and
rezone the parcel to (AH) affordable housing; and
WHEREAS, the Planning and Zoning Commission considered the applicant's request at a
public hearing on September 19, 1995 at which time the Commission voted unanimously to continue
the public heating to November 7, 1995; and
WHEREAS, the Planning and Zoning Commission considered the applicant's request at a
public hearing on November 7, 1995 at which time the Commission voted unanimously to deny the
Shadow Mountain Affordable Housing Project.
NOW, THEREFORE BE IT RESOLVED by the Commission:
That the Shadow Mountain Affordable Housing Project is hereby denied for the following reasons:
The applicant did not submit proof of notification for the public heating. There was also
considerable testimony from property owners within 300 feet of the subject parcel and
adjacent to it that they did not receive notice of the hearing.
The applicant has not supplied the Planning Office a current contract to purchase the parcel
or permission from the property owner to process this application.
The applicant was given specific direction regarding design alterations that needed to be
addressed before November 7th hearing. These items were not submitted to the Planning
Office for review by staff, the Commission, and the public prior to the hearing. These items
were to include:
the 60/40 (affordable housing/free market) bedroom mix has not been met;
realignment of the access road to be contiguous with 5th Street;
design a sidewalk, curb and gutter along W. Hopkins Ave;

reduce the size of the deed restricted units as they are proposed significantly larger
than required by the Housing Guidelines. The units should also be redesigned to
eliminate study areas and dens and to reduce the square footage size of the project;
relocate the project farther down the hillside;
address the historic significance of the Midland Railroad ROW with HPC to find a
acceptable design that enhances this historic landmark;
explore options to reverse the location of the free market and affordable housing on
the site to reduce the bulk, mass, and visual disturbance on the hillside;
reduce the density of the project to be compatible with the development patterns of
the neighborhood and to reflect the environmentally constrained parcel;
dedicate the Government Lot 18 land sliver on the parcel as public parkland;
the nordic trail has been located above the development, but no information on how
it connects with adjacent trail easements has been indicated; and
submit design information to show compliance with Ordinance 30 design review
requirements.
APPROVED by the Commission at its regular meeting on November 7, 1995.
