HomeMy WebLinkAboutresolution.apz.040-95 RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION GRANTING GMQS EXEMPTION FOR AN ESPRESSO CART Resolution No. 95- WHEREAS, the applicant, Before the Grind Corporation, submitted an application for a GMQS Exemption to operate an espresso cart in the atrium of the Ute City Banque Building (302-308 S. Galena St.); and WHEREAS, pursuant to Section 24-8-204.B. 1.a. of the Municipal Code, an expansion of a commercial use of less than 500 net leasable square feet may be exempted from the Growth Management Quota System (GMQS) by the Planning and Zoning Commission; and WHEREAS, the proposed espresso cart represents a total increase of 30 net leasable square feet; and WHEREAS, the Planning staff reviewed the application and recommended approval with conditions; and WHEREAS, the Aspen Planning and Zoning Commission reviewed the application at the regular meeting of December 19, 1995, and voted to approve the GMQS Exemption with conditions. NOW, THEREFORE, BE IT RESOLVED by the Commission that it does hereby grant approval of a GMQS Exemption to allow 30 square feet of new net leasable area for an espresso cart in the Ute City Banque Building, subject to the following conditions: 1. All representations made in this application shall be adhered to as conditions of approval. Resolution No. 95-__ Page 2 2. Prior to the issuance of a building permit, the applicant shall pay an affordable housing mitigation fee of $1659 to the City Finance Department. Proof of payment shall be provided to the Community Development Department. 3. If the espresso cart is in use for more than 3 hours per day, or for a period of more than 4 months (December to April), the applicant shall pay additional employee mitigation in effect at the time of review. 4. The espresso cart shall be reviewed and inspected by the Environmental Health Department prior to operation. APPROVED by the Commission at its regular meeting on December 19, 1995.
