HomeMy WebLinkAboutresolution.apz.001-88RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION RECOMMENDING THE ADOPTION OF THE CLARIFIED ASPEN LAND USE REGULATIONS AND THE REPEAL OF THE ASPEN ZONING ORDINANCE AND SUBDIVISION REGULATIONS Resolution No. 88- / WHEREAS, tions in a 1975, and 24 of the Municipal Code; and the Aspen Zoning Ordinance and Subdivision Regula- (hereinafter "The Land Use Regulations") were last revised comprehensive manner pursuant to Ordinance 11, Series of which implemented a complete recodification of Chapters 20 WHEREAS, since 1975, numerous amendments to the Land Use Regulations have been adopted, which have added layers of review to the land use decision making process; and W~REAS, in June, 1985, at a goals-setting session, the Aspen city Council (hereinafter, "The Council") identified "Land Use Code Simplification" as one of the City's top five priori- ties; and WHEREAS, to initiate the rewrite of the Land Use Regula- tions, the Council adopted Resolution 85-16, appointing a task force of local land use experts to help in identifying the problems with the Code and potential solutions to the problems; and WHEREAS, in a report dated November 25, 1985, the Task Force produced a detailed set of recommendations for changes to the Code, and a basic recommendation that a consultant be hired to perform the necessary drafting; and WHEREAS, in a memorandum to Council dated January 16, 1986, the staff defined the scope of the consultant's work and the Resolution No. Page 2 projects to consultant, 88- / be accomplished by staff in conjunction with the including revisions to the regulation of signs, floor area ratios, planned unit developments, and nonconformities, and the need for better definitions; and WHEREAS, in May of 1986, the City of Aspen entered into a consulting contract with the firm of Siemon, Larsen and Purdy to revise the Land Use Regulations; and W~EREAS, in August of 1986, the consultant produced a report summarizing the results of interviews conducted with community members identifying their concerns with Aspen's Land Use Reg- ulations; and WHEREAS, in October of 1986, the consultant produced a report containing an analysis of the problems in the Land Use Regulations and suggesting alternative solutions to these problems; and WHEREAS, in December of 1986, the consultant produced an annotated outline of the revised Aspen Land Use Regulations; and WHEREAS, throughout the second half of 1986, the Council met in work sessions to review the materials produced by the consul- tant and in a work session held on January 19, 1987, authorized the consultant to begin the drafting process; and WHEREAS, throughout the first half of 1987, the consultant and the staff met in work sessions with the Council and the Aspen Planning and Zoning Commission (hereinafter, "The Commission") to review draft articles of the revised Aspen Land Use Regulations; and Resolution No. 88- / Page 3 W/~EREAS, in August of 1987, the first complete draft of Articles 1 through 13 of the revised Aspen Land Use Regulations were made available for distribution; and and September of 1987, the Council and series of joint work sessions to review provide direction for further revisions; W/~EREAS, in August the Commission met in a the first draft and to and W~REAS, as a result of the joint work sessions and other public input received by staff, a second draft of the revised Land Use Regulations was made available for distribution; and W~EREAS, on November 3, 1987 a duly noticed public hearing was held by the Commission concerning the adoption of the clarified Land Use Regulations, which hearing was continued to November 17, December 1, December 8, and December 15, 1987 and January 5, January 12 and February 2, 1988; and W~EREAS, at the hearing on January 12, the Commission directed the staff to revise the tourist accommodations quota so that it regulates the annual number of bedrooms, rather than units, which are built; and W~EREAS, in order to revise the quota, staff recommends that the comprehensive vacant land buildout analysis first accomp- lished in support of the lodge quota be thoroughly updated; and WHEREAS, the staff committed to the Commission that this work would be completed during the time in which it is expected that Council will be considering adoption of the Commission's other recommendations, and that the staff would return to the Resolution No. 88- / Page 4 Commission at that time with a recommended new quota. NOW, THEREFORE, BE IT RESOLVED by the Commission: Section 1 That it does hereby recommend that the Council adopt as a new chapter 24 of the Municipal Code the clarified Aspen Land Use Regulations, attached hereto as Exhibit "A" and incorporated by reference. Section 2 That it does hereby recommend that the Council repeal the following sections of the Municipal Code: 1. Chapter 20, Subdivision. 2. Chapter 24, Zoning. 3. Section 7-143, Park Dedication Fee. 4. Chapter 2, Article II, Board of Adjustment and Article III, City Planning Commission. Chapter 3, Advertising. Se Section 3 That the provisions of this resolution shall not take effect, pursuant to Section 24-12.7(a) of the Municipal Code, until acted upon by the Aspen City Council.
