THE APPROVAL OF SPECIAL REVIEW FOR REDUCTIONS OF REQUIRED
PARKING, TRASH/UTILITY SERVICE AREA AND OPEN SPACE FOR 409 EAST

Resolution No. 90-
WHEREAS, Laura Donnelley, represented by Joe Wells submitted
an application pursuant to Growth Management competition for
Special Review in order to replace the existing structure and
redevelop the parcel; and
WHEREAS, 409 East Hopkins is located in the CC Commercial
Core zone district; and
WHEREAS, Section 7-404 B. of the Aspen Land Use Code
(revision date August 1989) allows the Planning Commissipn to
grant reduction of required off-street parking in the CC zone
with a cash-in-lieu payment of $15,000.00 for each space reduced;
and
WHEREAS, Section 7-404 C. of the Aspen Land Use Code allows
the Commission to grant reduction of required trash/utility
service area; and
WHEREAS, Section 7-404 A.(3) of the Aspen Land Use Code
allows the Commission to grant a reduction of required open
space within the CC zone district with a payment-in-lieu; and
WHEREAS, upon review of the referral comments submitted by
the Engineering Department, the Fire Marshal, and the Sanitation
District, the Planning Office recommended to the Commission
approval of the Special Reviews with conditions; and
WHEREAS, the Commission heard presentations by the Planning
Office and the applicant at their regular meeting of November 6;
and
WHEREAS, by a vote of 5-0 the Commission approved with
conditions the Special Reviews for reduction of required on-site
parking spaces and of trash/utility service area; and
WHEREAS, by a vote of 3-2 the Commission approved with
conditions the Special Review for a reduction of required open
space.
NOW, THEREFORE BE IT RESOLVED by the Commission: that it .
does hereby grant approval for Special Reviews for reductions of
on-site parking, trash/utility service area, and open space for
409 East Hopkins redevelopment with the following conditions:
1. P'rior to the issuance of any building permits the applicant
shall pay a parking fee for the amount of $270,000 to the Finance
Department.
2. Prior to the allocation of net leasable square footage by the
City Council, the applicant shall clarify with the Housing
Authority the employee generation number to be used for this
application.
3. Prior to the issuance of any building 'permits the applicant
shall pay an open space fee of approximately $387,600, the amount
shall be determined pursuant to Section 7-404 A(3) and payable to
the Finance Director.
4. The Engineering Department has no record of a transformer
easement on this parcel. A transformer easement shall be filed
with the Engineering Department prior to the issuance of any
building permits.
5. Prior to the issuance of any building permits an adequate
trash service area shall be indicated on the final plans and the
applicant shall supply a letter from BFI, to the Engineering
Department, which supports the reduction in the trash/utility
area.
6. Prior to the issuance of a Certificate of Occupancy the
trash/service area shall be inspected and certified, by the
Engineering Department, in compliance with the proposal.
