(LOTS K AND L, BLOCK 8, TOWNSITE OF ASPEN) Resolution No. 90-_~_ WHEREAS, A.T. Dickens submitted an application for a Conditional Use to allow 400 s.f. Accessory Dwelling Unit to be developed within the basement of his proposed residence at 504 Eighth St. as housing mitigation required by Ordinance 1 (1990) for the demolition of the existing residence; and WHEREAS, the Planning Office and the Housing Authority had reviewed the application and recommended approval with conditions; and WHEREAS, The Planning and Zoning Commission met on January 8, 1991 and having considered the Planning Office's recommendation, approved the application pursuant to Section 5- 508 of the Aspen Land Use Code with amended conditions. NOW, THK~EFORE BE IT RESOLVED by the Commission with a 5-2 vote: That the Conditional Use for a 400 s.f. basement level Accessory Dwelling Unit is approved with the following conditions: 1. Prior to the issuance of any demolition permit, the existing residence shall receive a building inspection by the Zoning Official and a determination of the square footage of the structure shall be made from appropriate documentation. 2. Prior to issuance of Building Permit, the Accessory Dwelling Unit must be deed restricted for a period of fifty years as a resident occupied unit with a six month minimum lease. The Housing Authority must approve the deed restriction prior to it being filed with the Pitkin County Clerk and Recorder's Office. 3. The developer shall provide three exterior hard surface parking spaces on site. APPROVED by the Commission at its regular meeting on January 8, 1991.
