HomeMy WebLinkAboutapz.res.012-91A RESOLUTION OF 'I'VE ASPEN PLANNING AND ZONING COMMISSION FOR TH~ APPROVAL OF AN AM~I~DHENT TO 'r~ CONDITIONAL USE FOR THE ~[ESSIAH Lu'r-~.~kAN CfluKCH FOR AN ADDITION OF A DEED RESTRICTED AFFORDABLE HOUSING ~NIT AT 1235 MOUNTAIN VIEW DRIVE (PARCEL A, BLOCK 3 WEST MEADOWS SUBDMSION) R~SOLuT~ON ~91- /~ W~d~AS, the Messiah Lutheran Church had been exploring ways to provide an affordable housing opportunity for its minister and family within the Aspen Area; and W~t~a{]~AS, the Pitkin County Bank was awarded 1990 Commercial GMP allotments with an affordable housing mitigation requirement for 4.7 employees; and W~]~KEAS, the Bank and the Church joined efforts to devise a plan which would satisfy both of their housing needs; and W. Kw~2~S, a housing mitigation plan for the Bank was approved by city Council through the adoption of Resolution #5, Series 1991, whereby 3 of the 4.7 employee housing needs would be satisfied by the addition of a 1,430 s.f. three bedroom deed restricted unit onto the Messiah Lutheran Church; and W~KKEAS, the Pitkin County Bank, on behalf of the Messiah Lutheran Church, applied for an amendment to the Church's 1985 Conditional Use approval for the construction of the deed restricted unit; and W.K~EAS, the proposal was reviewed by the Engineering Department, Housing Authority, Fire Marshal, and the Planning office; and W~Y/~EAS, at a public hearing on May 7, 1991, the Planning and Zoning Commission reviewed the proposal and considered referral comments, and approved the proposal with conditions as amended by a 5-0 vote. NOW THEREFORE BE IT RESOL¥~ by the Aspen Planning and Zoning Commission that is does approve an amendment to the Messiah Lutheran Church Conditional Use for a 1,430 s.f. deed restricted affordable housing unit with conditions, and forwards a recommendation to city Council for GMQS Exemption for affordable housing. The Conditional Use is amended with the following conditions: 1. Prior to issuance of Building Permit, the affordable housing unit must be deed restricted with the Housing Authority and filed with the Pitkin County Clerk and Recorder for Category #3 rental/sales guidelines in place at the time of recordation. Proof of recordation with the County Clerk shall be forwarded to the Planning office. 2. Occupancy priority shall be given to the Church's minister. However, if necessary for the specific use by the Messiah Lutheran Church's minister and family, the Category #3 asset and income guidelines may be exceeded. 3. In the event that the church minister does not occupy the unit, the church may rent the unit to other occupants who qualify with all of the Category #3 guidelines, provided however that such occupancy shall be by a family related by blood or marriage. 4. The owner (Messiah Lutheran Church) is obligated to keep the units occupied with qualified tenants and is obligated to notify the Housing Authority when the unit is vacant. 5. Prior to the issuance of a building permit, the well water shall be tested for quality and quantity and approved by the Environmental Health Department. 6. A dust control program for the parking lot shall be approved by the Environmental Health Department and implemented by the Church. 7. Ail material representations made by the applicant in the application and during public meetings with the Planning and Zoning Commission and City Council shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions.
