HomeMy WebLinkAboutapz.res.016-91RESOLUTION OF THR ASPEN PLANNING AND zONING COMMISSION FOR CONDITIONAL USE APPROVAL OF Tug DETACHED ACCESSORY DW~.LLING UNIT LOCATED AT 533 WEST H~T.T.AM STREET, ASPEN COLORADO Resolutlon No. 91-~ W~uu(F2%S, the Planning and Zoning Commission held a public meeting March 5, 1991; and W~KREAS, pursuant to Section 5-508 a detached accessory dwelling unit is a conditional use review requiring a public hearing; and WHEREAS, the Planning staff recommended approval of the detached accessory dwelling unit with conditions; and WH~%S, the Commission amended the recommendation changing the size of the accessory dwelling unit from 682 to 611 square feet; and NOW, .i.~EFORE BE IT RESOLVED by the Commission that it does hereby approve the conditional use for a detached accessory dwelling unit located at 533 West Hallam Street with the following conditions: 1. Prior to issuance of any building permits for remodel of the accessory dwelling unit or the principal residence, the applicant shall provide a deed restriction to the Housing Authority for approval. The restriction shall state that the accessory unit meets the hosing guidelines for such units, meets the definition of Resident Occupied Unit, and shall be rented for periods of six months or longer. Upon approval of the deed restriction by the Housing Authority, the applicant shall record the deed restriction with the Pitkin County Clerk, Recorders office and Planning Department. 2. The floor area of the detached accessory dwelling unit shall not exceed 611 square feet, the mean height shall not exceed 16 feet and the distance between the two buildings shall not be decreased beyond 5 feet.
