HomeMy WebLinkAboutapz.res.022-91 RESOLUTION OF THE ASPEN PI~.NNING ~ ZONING COH~fISSION FOR THE APPROVAL OF A CONDIT~ON~I, USE FOR A DAY CARE CENTER FOR THE E~RLY LEARIN~NG CENTER LOCATED AT THE NORTHWEST CORNER OF BLEEKER STREET, BLOCK 57, ASPEN TO~SITEo RESOLUTION #9~-22 ~HEREAS, the Aspen School District has determined that a need exists for day care services within the City of Aspen; and WHEREAS, the In-Town School Sites Committee has studied the reuse of the intown schools and has recommended that the yellow brick school site be utilized for day care related uses; and WHEREAS, the Early Learning Center Board plans to open the Early Learning Center on September 1, 1991 and it will be licensed by the Colorado Department of Social Services; and WHEREAS, Section 5-201 c. of the Aspen Land Use Regulations lists "day care center" as a conditional use in the R-6 zone district and the Early Learning Center meets the definition of a day care center; and WHEREAS, The Early Learning Center is compatible with the surrounding residential area and will have less adverse impact than previous use which was an elementary school; and WHEREAS, The Early Learning Center Board applied for a Conditional Use approval to convert the yellow brick school into a day care center; and WHEREAS, the proposal was reviewed by the Engineering Department, Environmental Health Department, Parks Department, and the Planning Office; and WHEREAS, at a public hearing on July 16, 1991, the Planning and Zoning Commission reviewed the proposal and considered referral comments, and approved the proposal with conditions by a 5-0 vote. NOW THEREFORE BE IT RESOLVED by the Aspen Planning and Zoning Commission that is does approve the Conditional Use for the day care center which will be located within the yellow brick school. The Conditional Use is approved with the following conditions: 1. The applicant shall consult city engineering for design considerations of development within public rights-of-way and shall obtain permits for any work or development within public rights- of-way from city streets department. A five foot wide pedestrian useable space must be allowed between the property line and the edge of pavement. 2. Prior to the issuance of a building permit, the applicant shall consult with the Environmental Health Department regarding radon mitigation measures. 3. Ail representations made in the application and those reviewed and approved by the Planning and Zoning Commission shall be complied with by the applicant. 4. Prior to the issuance of a building permit, the water supply shall be evaluated for the presence of lead solder. 5. The applicant should foward a copy of the landscape plan to the Parks Department prior to the installation of landscape materials. APPROVED by the Commission at its regular meeting on July 16, 1991.
