HomeMy WebLinkAboutapz.res.025-91 Whe~e&s meeting June RESOLUTION OF THE ASPEN pL4%NNING AND ZONING COMMISSION RECOMMENDING THE SPECIAL REVIEWAPPROVAL OF OUTDOOR SE~TING IN REQUIRED OPEN SPACE Resolution No. 91- ~L~ the Aspen Planning and Zoning Commission held a 18, 1991; and Whereas, Legends of Aspen requested Special Review for outdoor recommended approval of the seating in required open space; and Whereas, the Planning staff special review with conditions; and Whereas, applicant and Commission amended the conditions of approval. NOW, THEREFORE, BE IT RESOLVED by the Planning and Zoning Commission: That it does hereby approve the Special Review for outdoor seating at 325 East Main Street, Aspen with the following conditions: 1. The applicant shall consult City Engineering for design considerations of development within public rights-of-way and shall obtain permits for any work or development within public rights- of-way from city Streets Department. 2. Prior to the issuance of a Certificate of Occupancy, the applicant shall provide assurance to the Building Department that the supports are designed to handle additional loads other than the fence itself, i.e. hikes or people leaning against it, the swing of the gates, etc.. 3. The applicant shall establish seating for only 22 seats out- side and shall provide a controlled area by using a fence type as approved by the HPC. 4. The fence shall be redesigned slightly to eliminate the saw- tooth picket top; height shall not exceed 42". The fence is seasonal/temporary, and is to be taken down in the winter. The gate shall be a bi-swing gate and be recessed so it does not swing out into the public right-of-way. APPROVED by the Commission at their regular meeting June 18, 1991.
