HomeMy WebLinkAboutapz.res.028-91RESOLUTION CONDITIONAL LOCATED AT SUBDIVISION, WHEREAS, the meeting August 20, WHEREASw dwelling unit hearing; and OF THE ASPEN PLANNING AND ZONING COMMISSION FOR USE APPROVAL OF THE ATTACHED ACCESSORY DWELLING UNIT 1270 MOUNTAIN VIEW DRIVE, LOT 8 BLOCK 1, WEST MEADOW ASPEN COLORADO Kesolutlon No. Planning and Zoning commission held a public 1991; and pursuant to Section 5-201 an attached accessory is a conditional use review requiring a public WHEREAS, the Planning staff recommended approval attached accessory dwelling unit with conditions; and WHEREAS, the Commission amended the recommendation of the changing the conditions of approval to enable a variance processes for a curb cut and requiring that applicant review storm drainage management impacts with the Engineering Department. NOW, THEREFORE BE IT RESOLVED by the Commission that it does hereby approve the conditional use for a 322 square foot attached accessory dwelling unit located at 1270 West Mountain View Drive, Lot 8 Block 1, West Meadow Subdivision with the following conditions that prior to the issuance of any building permits: a. the applicant shall, upon approval of the deed restriction by the Housing Authority, record the deed restriction with the Pitkin County Clerk, Recorders Office and Planning Department. The deed restriction shall state that the accessory unit meets the housing guidelines for such units, meets the definition of Resident Occupied unit, and if rented, shall be rented for periods of six months or longer. b. all representations that are made in the application and those reviewed and approved by the Planning and Zoning Commission shall be complied with. c. parking spaces for the primary residence shall be shown on the site plan. d. redevelopment of the property shall provide one curb cut that is either ten (10) feet in width for a single driveway or eighteen (18) feet in width for a double driveway or the applicant may seek a variance through the Engineering Department. e. the applicant shall consult city engineering for design considerations of development within public rights-of-way and shall obtain permits for any work development within public rights-of- way from city streets department. A five foot wide pedestrian usable space must be allowed between the property line and the edge of pavement. f. the applicant shall agree to join any future districts which may be formed for the purpose of improvements in the public right-of-way. improvement constructing g. the applicant shall review with the Engineering Department potential storm water drainage management issues. h. Pursuant to a conditional use approval, the Planning Director shall file a GMQS Exemption for one attached accessory dwelling unit. APPROVED by the Commission at its regular meeting on June 18, 1991.
