UNIT ~T THE KREBS RESIDENCE, 916 W. SMUGGLER (LOT 2v V~NDEMOER LOT
SPLIT)
Resolution No. 90-9
WHERE~S, George and Alice Krebs submitted to the Aspen
Planning office an application for a Conditional Use for a 303
square foot Accessory Dwelling Unit in their residence to be built
at 916 W. Smuggler St.; and
WHEREAS, an Accessory Dwelling Unit is required for any
development resulting from a Lot Split action; and
WHEREAS, the subject parcel was created by the Vandemoer Lot
Split approval in 1986; and
WHEREAS, the Planning office reviewed the application in
consideration of Housing Authority standards and review criteria
for Conditional Uses contained in Section 7-304 of the Aspen Land
use Code; and
WHEREAS, the Planning office recommended approval of the
Conditional Use with conditions to the Planning and Zoning
Commission; and
WHEREAS, during a public hear at their regular meeting on
September 3, 1991 the Planning and Zoning Commission approved by
a 4-0 vote the Krebs Conditional Use with conditions.
NOW, THEREFORE BE IT RESOLVED by the Commission that a
Conditional Use is approved for a 303 square foot accessory
dwelling unit to be included within the basement of the residence
at 916 W. Smuggler with the following conditions:
1. The owner shall submit an appropriate deed restriction with the
Aspen/Pitkin County Housing Authority for approval. The unit shall
be deed restricted to resident occupancy with minimum 6 month
leases. Upon approval by the Housing Authority the Owner shall
record the deed restriction with the Pitkin County Clerk and
Recorder's office.
2. Prior to issuance of any building permits for the accessory
dwelling unit, a copy of the recorded deed restriction must be
forwarded to the Planning office.
