FOR THE APPROVAL OF A CONDITIONXL USE FOR ~N ACCESSORY DWELLING
UNIT AT THE U~R~INE RESIDENCE ON SIERRXVISTA DRIVE (LOT 15 WEST
ASPEN SUBDIVISION)

waBR~S, John Ukraine submitted to the Aspen Planning office
an application for a Conditional Use for a 672 square foot
Accessory Dwelling Unit in his residence to be built at Lot 15,
West Aspen Subdivision; and
W~ERF~S, the Accessory Dwelling Unit is proposed as affordable
housing mitigation under the options provided within Ordinance 1,
the housing replacement ordinance; and
W~ER~S, the Planning office and Engineering Department
reviewed the application in consideration of Housing Authority
standards and review criteria for Conditional Uses contained in
Section 7-304 of the Aspen Land use Code; and
W~EREAS, the Planning office recommended approval of the
Conditional Use with conditions to the Planning and Zoning
Commission; and
W~ER~AS, during a public hear at their regular meeting on
October 8, 1991 the Planning and Zoning Commission approved by a
6-0 vote the Ukraine Conditional Use with amended conditions.
NOW, THEREFORE BE IT RESOLVED by the Commission that a
Conditional Use is approved for a 672 square foot accessory
dwelling unit to be included within the basement of the residence
at Lot 15, West Aspen Subdivision with the following conditions:
1. The owner shall submit an appropriate deed restriction with the
Aspen/Pitkin County Housing Authority for approval. The unit shall
be deed restricted to resident occupancy with minimum 6 month
leases. Upon approval by the Housing Authority the Owner shall
record the deed restriction with the Pitkin County Clerk and
Recorder's Office.
2. Prior to issuance of any building permits for the accessory
dwelling unit, a copy of the recorded deed restriction must be
forwarded to the Planning office.
3. The development must comply with curb cut requirements as
stipulated by the city Engineer.
4. Permits are required from the City Streets Department for any
work within the public rights of way.
5. The applicant shall agree to join in any future improvement
districts which may be formed for the purpose of constructing
improvements in the public right-of-way.
6. The applicant must demonstrate that the proposed conditional
use maintains or decreases the historic run-off for this property
prior to issuance of a building permit.
7. The construction shall include a sound transmission co-
efficient of 50 or greater between the main dwelling and the
accessory unit.
APPROVED by the Commission at its regular meeting on October
8, 1991.
