WHERF~B, the Aspen Planning and Zoning commission held a
meeting October 22, 1991; and
WHERE~S, the Commission reviewed an application for a stream
margin review for the construction of a pedestrian trail and kayak
course in the Roaring Fork River adjacent to the Rio Grande
property; and
WHEREAS, pursuant to Section 24-7-504 development within 100
feet from the high water line of the Roaring Fork River and its
tributary streams, or within the one hundred year floodplain is
required to undergo Stream Margin Review; and
WHEREAS, the Planning staff reviewed the application and
recommended approval with conditions; and
WHEREAS, the Commission reviewed the application and amended
the conditions of approval to include:
3. Boater put-in and take-out including parking shall be
addressed for the course. This will occur prior to and during
the Master Plan effort.
4. The City Attorney shall review the liability impacts of
this whitewater course.
5. Additional stream margin review is anticipated to complete
the course; and

WHERE~S, the applicant requested an amendment to the stream
margin review to place fill from the kayak course behind the Eagles
Club for a foot path connecting Spring Street to Newbury Park; and
the Commission reviewed the amendment and added a

NOW, THEREFORE, BE IT RESOLVED by the Commission that it does
hereby grant stream margin approval and an amendment to the
approval for the construction of a kayak course in the Roaring Fork
River, a pedestrian river trail on the Rio Grande property and the
placement of fill behind the Eagles Club for a foot path connecting
Spring Street to Newbury Park with the following conditions:
1. Prior to construction:
a. the applicant shall provide a set of drawings stamped by the
engineer who performed the hydraulic analysis and shall be reviewed
and approved by the Engineering Department;
b. an erosion mitigation plan shall be approved by the Engineering
Department and the plan shall include, but not limited to,
revegetation of disturbed areas;
c. tree removal permits are required from the Parks Department
before any trees greater than 6" in caliper may be removed. Every
effort should be made to relocate on site the trees that must be
disturbed;
d. necessary 404 Permits shall be obtained and provided to the
Engineering Department; and
e. the colorado Water Conservation Board shall be notified of
changes to the river channel and shall be notified for additional
work.

6. Prior to the removal of any trees greater than 6" caliper tree
removal permits must be obtained from the Parks Department. Any
tree removed shall be replaced on site pursuant to the Parks
Department standards.
7. All fill shall be stabilized and landscaped by the Spring of
1992.
8. Neighborhood concerns shall be resolved prior to the placement
of fill in Newbury Park.
9. Placement of fill shall in no way encroach into the 100 year
floodplain without further review.
10. Prior to placement of fill the city Attorney's office shall
review the liability impacts.
APPROYED by the Commission at its regular meeting on October
22, 1991 and amended November 19, 1991.
