SOLUTIO~ OF THE ASPEN PLAe~.~G AND ~ONI~G COI~ISSIO~ RECO~,~I[~ T~AT T~IE ASPEN (~TY CO~]~(~L PROCEED P~CES~ OF ~E ~P~ ~ ~ Resoluttm No. 85-7 WI~EREAS, on August 27, 1984, the Aspen City Cotmcil (hereinafter 'Council") did grant permission to the Applicants for the Aspen Motmtain PUD to phase the preliminary review of the lodge and residential components of the PUD, provided that the approval of any preliminary stage not be effective until the preliminary review for the e~tire PUD has been approved; and WHEREAS, pursuant to said action, the Aspen Planning and Zoning Commission (hereinafter 'Commission") has been reviewing the two components of the PUD on a phased basis since November, 1984; and WHERE~, it is the Commission's belief that the intent of with- holding final approval for the entire PUD until both components have been reviewed was to insure comprehensive , integrated review of such issues as site design, architecture and circulation; and WHEREAS, in its review of the two components, the Commission has insured that the Applicants have adequately addressed all conditions imposed by Council during its conceptual review with respect to site design, architecture and circulati~; and WHEREAS, the Applicants have been unable at this time to resolve all possible concerns with respect to natural hazards affecting the Top of Mill site, principally due to the fact that the critical period for study of these hazards will be during the Spring of 1985, rather than in the prior months when the hazard studies got underway; and WHEREAS, based upon this inability to resolve the hazards issue tmtil later this year, the the Top of Mill portion of time; and Commission has determined that approval for the site only should not be granted at this WHEREAS, the Applicants for the Top of Mill project are prepared to move ahead with the final processing for the remainder of the project pose no requested by project and have agreed to mdertake the hazard studies the Colorado Geolological Survey; and WHEREAS, the Commission has determined that if the Top of Mill is unable to ultimately obtain approval, this result would risk to the City since it is separable from the remainder of ResolutiGn NO. 85- ~ Page 2 the PUD and since the basic amenity package associated with the PUD is largely contained within the hotel site; and WIIEREAS, Section 24-8.7 requires that the Applicants' conceptual presentation "reflect the proposed development for the entire ownership"; and WIIEREAS, in conformance with said Section 24-8.7, the Applicants did submit both a conceptual and preliminary submission reflecting the proposed development for the ontire ownership; and WEEREAS, Section 24-8.10 provides that the Commission shall approve, disapprove or approve subject to modifications the preliminary plan; and does not prohibit the Commission from granting an approval to a portion of a site only; and WHEREAS, the Commission believes that it is imperative that public review continue on the lodge component of the Aspen Mountain PUD, such that the demolition and construction schedule can be met, allowing the Applicants to minimize the disruption the project will cause residents of and visitors to the City of Aspen. NOW, T~EREFORE, BE IT RESOLVED by the Commission that it does hereby recommond that Council proceed with the processing of the Final Plat for the Aspen Mountain PUD, despite the fact that action on the Top of Mill portion of the project will need to be withheld until a later date. The Commission refers the Cocci1 to its Resolutions 85-1 and 85-6 for its specific conditions of approval for the Lodge/Resi- dential components of the PUD.
