CONFIRMING THE APPROVAL OF THE ASPEN ~OUNTAIN I~JD/SUBDIVISION
PRELIMINARY SUBMISSION AND COMMENTING TO CITY COUNCIL
Resolution No. 85- 8
W~EREAS, certain members of the public have objected to the
public hearing notice given by the Applicants for the Aspen r.~ountain
PUD/Subdivision for the Preliminary PUD/Subdivision reviews by the
Aspen Planning and Zoning Commission (hereinafter the "Commission"); and
~[{EREAS, in response to these objections, a duly noticed public
hearing was held before the Commission on April 30, 1985.
NOW, THEREFORE, BE IT RESOLVED by the Commission that it does
hereby confirm its approval granted to the Aspen }~ountain PUD/Sub-
division, Preliminary Submission~ in its prier resolutions 85-1 and
85-6, provided that the following changes from those resolutions be made:
I. Change Resolution 85-1, Section 2, Condition 3 to read as
follows:

Change Resolution 85-6, page 3, Further Resolved, Condition
5 such that the reference to restrict the employee housing
units at the time of building permit issuance now refers to
the time of issuance of the Certificate of Occupancy for the
residential projects.
Recognize that Condition 14 of P&Z Resolution 85-1, regarding
the need to approve the residential and lodge components of
the project to make the prelir:~inary approval effective~ has
now been superceded by the Commission's decision to delay
the review of the Top of Mill project and to recommend that
Council proceed with the Final Plat for the rest of the
project, all as outlined in P&Z Resolution 85-7 and in the
last resolved paragraph of Resolution 85-6.
BE IT ALSO RESOLVED by the Commission that it does hereby make
the following additional comments to the Aspen City Council regarding
the project:
The Commission expresses its support for the reconfiguration
of the service area for the hotel as an improvement to the
overall design of the building. The Commission expects that
the representations of the Applicants as to the area's
landscaping, the enclosure of the trash compactor and other
matters will be adhered to during the final plat and building
permit review processes. The Commission also expresses its
support for the addition of 1,200 sq. ft. of floor area to
the project' s FAR calculations to properly enclose the
service area.
The Commission re-expresses its condition regarding the tree
removal, relocation and replacement program for the PUD that
the ultimate authority in this matter should remain with the
City Parks Director. The Commission expects that the Parks
Director will review the most current tree plan and place a
signed copy of this plan in the records of the Building
Inspector for his use in enforcement matters. The Commission
also suggests that in those cases where the Parks Director
finds trees which were to be relocated but eventually
replaced that must now be removed, he require their replacement
by the Applicant with relatively comparable sized trees~ as
feasible.
