APPEAL OF THE (}UZLL~ LAWSUIT
Resolution No. 84- 13
WH~EAS, the Aspen Planning and Zoning Commission has received
correspondence from the City Attorney indicating that the Colorado
Court of Appeals has reversed the District Court ruling, which had
been in favor of the City, in the case known as Quillen v. Planning
and Zoning Commission, City Council, et. al; and
WHEREAS, the Commission believes that the City should continue to
litigate the issues involved by proceeding with a petition for rehearing
and eventual appeal to the Colorado Supreme Court.
NOW, ~E~EFORE, BE IT RESOLVED by the Planning and Zoning Commission
of the City of Aspen, Colorado, that it does hereby recommend to the
Aspen City Council that it continue to litigate the issues involved in
the Quillen case by proceeding with a petition for rehearing and
eventual appeal to the Colorado Supreme Court.
APPROVED unanimously by the Aspen Planning and Zoning Commission
at its regular meeting on Nov~ber 6, 1984.
