HomeMy WebLinkAboutresolution.apz.003-83 RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION RECOMMENDING TO TUE ASPEN CITY COUNCIL REZONING OF RUBEY PARK FROM "PARK" TO "PUBLIC/SPA"; ADOPTION OF THE PRECISE DEVELOPMENT PLAN: EXEMPTION FROM GROWT~ MA:iAGEMENT COMPETITION FOR THE 9,070 SQUARE FEET OF PUBLIC SPACE, AND ONE EMPLOYEE UNIT; AND EXEMPTION FROM THE REQUIREMENT FOR PARKING FOR THE EMPLOYEE UNIT Resolution No. 83 - ,~ WHEREAS, the Aspen Planning and Zoning Commission held a public hearing on April 5, 1983 at which time it did consider applications requesting the rezoning and adoption of a precise plan for a transportation center to be located at Rubey Park (more specifically, Lots K, L, M, N, O, P, Q, R and S, Block 90, Original Aspen Townsite) and, WHEREAS, the project has previously been a~varded a development allotment for 5,810 square feet of commercial space through the 1982 Commercial GMP competition, and, WHEREAS, the proposal to rezone was found to be compatible with surrounding zone districts and land use in the vicinity of the site, and WHEREAS, the cost of the public components of the center are being underwritten by the developer through the allotted commercial square footage, and WHEREAS, the 1973 Voorhees Regional Transportation Plan identifies Rubey Park as the location for Aspen's transit center and for skier staging operations, and, WNEREAS, an employee housing unit of 850 square feet was a part of the GMP application, and WHEREAS, parking for the occupants of the unit is not vital considering the proximity to the Commercial Core, all bus routes, and the mountain, and WHEREAS, the site design as finally approved will represent the precise plan for development of the parcel and will set the area and bulk requirements, and WHEREAS, certain public uses are essential to the efficient operation of the transit terminal and may be exempted from Growth Management competition per Section 24-11.2(e) of the Municipal Code as amended by Ordinance 53, Series of 1982, and WHEREAS, the Planning and Zoning Commission is concerned that the uses in the public space be limited to those with a Cultural, educational, governmental, quasi-governmental orientation, and serve a civic purpose. NOW, THEREFORE, BE IT RESOLVED by the Aspen Planning and Zoning Commission that a recommendation be forwarded to the Aspen City Council that the following actions be taken: Rezoning of the Rubey Park parcel from "P-Park" to "PUB/SPA - Public/SPA" with T-D overlays. o Adoption of the precise development plan as submitted and amended in this review process. Exemption from Grpwth Mana§ement competition for the 9,070 square feet of Public space and the accessory use area of limited food service. Exemption from Growth Management competition for the 850 square foot "moderate" income employee unit and a further exemption from the provision of parking for the unit. 5. The permitted and conditional uses be as follows: Permitted Uses Public building for administration of transportation services limited to the following and similar uses; bus service, bus charter and package service, cab and limousine phones. Public building for administration of winter and summer resort . services limited to the following and similar uses: box office, better business bureau~ booking agency, convention bureau, central reservations agency, chamber of commerce, entertainment bureau, expedition and guide services, educational services, 'nordic or alpine ski operator, resort association, tourist information bureau, ticketing and weather information service. Co Food service limited to the following and similar uses: snack bar, tearoom, coffee shop or cafe. Retail commercial establishments limited to the following and similar uses: air travel ticket agency, airline company, air express, air package service, air charter, art gallery, auto club, bicycle rental, bookstore, camera shop, drug store, florist shop, news service, photography shop, recreation/sporting goods store, stationery store, coin vending and lockers, travel agent, tour operator. e. Business office, financial institution. Storage of materials accessory to any of the above listed uses provided all such storage is located within the structure. Conditional Uses Restaurant, trade association. Operations that may be "commercial" or "public", depending on details of operation, may apply through conditional use review to be included in the Public space. The recommended conditions to these recommendations are: 1. The provision of on-site drywells for the detention of storm drainage. 2. The submission of the deed restrictions, for approval by the City Attorney's office, for the "moderate" income employee unit. 3. Redesign of landscaping in the alleyway and Mill Street Mall area to assure passage of delivery and service vehicles and an adequate staging area. APPROVED by the Aspen Planning and Zoning Commission at their regular meeting on April 26, 1983.
