ASPEN PLANNING AND ZONING COMMISSION
RECOMMENDING APPROVAL OF A
SPECIFIC PLAN WHICH AMENDS THE
SPECIALLY PLANNED AREA PLAN OF THE
TREUMAN NEIGHBORHOOD COMMERCIAL CENTER

WHEREAS, Lot 3 of the'Trueman Neighborhood Commercial Center is p~rt of an
existing SPA plan and the development of the lot requires that an amendment to
the SPA be processed by approval of the specific development plan for Lot 3,
and
WHEREAS, the proposed plan for the Aspen Downtown Storage project has
received a growth management allotment for 7,000 square feet of commercial
space which represents one year's quota in the SCI zone, and
WHEREAS, the applicant has made efforts to respond to the very sensitive
nature of surrounding land uses, and
WHEREAS, one important concession offered by the applicant is the dedica-
tion to the City of the rear 120 feet of the property for use as a park, and
WHEREAS, the Planning and Zoning Commission feels that relocation of the
trail to the west side of the property affords open space views and is
preferable to its location on the east side, but will require that certain
easements be secured, and
WHEREAS, warehousing and storage are permitted uses in the S/C/I zone
and are relatively low impact in comparison with other permitted uses, and
WHEREAS, the project does conform to all area and bulk requirements of
the S/C/I zone, excepting the placement of the Koch Lumber Co. building (which
will house the manager's office and apartment) such that there is a 5 foot
front yard, and
WHEREAS, the project has been reviewed in accordance with the criteria
of Section 24-12.5 and was found to be in substantial compliance, and
WHEREAS, earlier recommendations made to Council by the Planning and
Zoning Commission in the GMP process included Resolution 82-12 which
encouraged the purchase of the property for open space and a recommendation
following the scoring process that an allocation be given to allow complete
construction of the project in one year.
NOW, THEREFORE, BE IT RESOLVED by the Aspen Planning and Zoning Commission
that they encourage Council to give the highest priority to purchase of Lot 3
for open space.
BE IT FURTHER RESOLVED that the Planning and Zoning Commission recommends
that if Council does not agree to purchase, that the following actions be
taken:
(a)
The City commit to negotiate and purchase the easement on the
west side of the property for trail and landscape purposes. The
applicant has committed to pay for all trail improvements and
landscaping.
(b) The allocation be increased to allow full construction of the project
in one year.
(c)
Approval of the Specially Planned Area plan for the Downtown Storage
project as an amendment to the Trueman Neighborhood Commercial Center
SPA with the following conditions:
(1) Retention of the existing easement for storm drainage and access
to Jenny Adair Park along the westerly property line.
(2)
Evidence of agreement from the Aspen Sanitation District and
Holy Cross Electric with the plan regarding existing facilities,
setback needs and potential relocations prior to final Council
approval.
(3)
Evidence of assurance from adjacent property owners that
easements are available to accommodate the trail relocation,
grading and landscape needs prior to final Council approval.
(4)
Repositioning the location of the storage buildings and the
Koch Lumber Co. structure such that a 5 foot front yard exists
on Puppy Smith Street.
(s)
Grading and access requirements for the parcel be submitted to
and accepted by the City Engineering Department prior to
construction.
(6) The Koch building (manager's office and residence) be hooked
up to City Water and AMSD sanitary sewer lines.
(7) Signage be provided on-site to notify vehicle operators of the
15 minutes idling ordinance.
(8) All run-off from paved areas and roof drainage be contained on
the site.
(9) Provision of three parking spaces at the Koch Lumber Co. building
site.
(10) Fencing be provided of natural materials which is high enough to
obscure the view of first level storage activity.
(11) Lighting be low-key and have limited hours of use in consideration
of the wildlife sanctuary.
APPROVED by the Planning and Zoning Commission of the City of Aspen at its
regular meeting on May 17, 1983.
