HomeMy WebLinkAboutresolution.apz.011-80 RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION REGARDING A CODE AMENDMENT ALLOWING EMPLOYEE UNITS IN NON-CONFORNING LODGES Resolution No. 80 - m' ll WHEREAS, the Aspen Planning and Zoning Commission considered a proposed code amendment allowing employee units in non-conforming lodges at a public hearing on July 8, 1980, and WHEREAS, the Commission supports the concept of addition of floor area, regardless of non-conforming status, because of the need for employee housing, especially for commercial uses, documented in the Housing Task Force Report of 1980, and WHEREAS, the Commission requested certain modifications tailoring the review criteria to the different circumstances of single family versus the more dense zone districts. NOW, THEREFORE, BE IT RESOLVED by the Aspen Planning and Zoning Commission that it does hereby recommend approval of a code amendment allowing additions to non-conforming lodges through the conditional use review process subject to the following conditions and review criteria: 1. For non-conforming lodges located within the R-6 through R-40 zones, limitation to 660 square feet and/or additional square footage in a basement, additional square footage by special review pursuant to the guidelines outlined in #2 of this resolution. The units must be attached unless there is a pre-existing shed or accessory structure in which case the structure could be converted provided the floor area remained the same and the improvement was reviewed as compatible with the scale of the surrounding area. 2. For non-conforming lodges in the R/MF, CC, C-1, S/C/I, NC and 0 zones, unlimited expansion provided there is no increase in lodge units. Review and approval pursuant to review criteria as follows: a. Compliance with any adopted housing plan, specifically the need for seasonal employee rooms and deed restriction against commer- cial rental or sale. b. Maximization of construction quality and unit size. c. Minimization of adverse environmental and social impacts. d. Compatibility with surrounding land uses and zoning including area and bulk requirements of the underlying zone district. e. Adequacy and availability of utilities. 3. In all zones: deed restriction to price guidelines and against commercial rental or sale. 4. Health, safety and fire inspection and compliance prior to approval.
