AND ZONING COMMISSION REGARDING A PROPOSED
AMENDMENT TO SECTION 24-10 OF THE ZONING
CODE OF THE CITY OF ASPEN

WHEREAS, at a special meeting on February 10, 1981, the Aspen Planning
and Zoning Commission by motion initiated consideration of an amendment to
Section 24-10 of the Zoning Code of the City of Aspen, and
WHEREAS, said amendment would add "dormitory" as a permitted use under
the provisions of the Residential Bonus Overlay section of the R-6 zone dis-
trict, and
WHEREAS, in considering said amendment, the Planning and Zoning Commis-
sion has concluded:
1. Protection against possible misuse of said amendment in sensitive
R-6 neighborhoods already exists in the regulation (Section 24-10.3)
since application of a Resi'dential Bonus Overlay in the R-6 zone dis-
trict is permitted only on vacant sites in excess of one acre.
2, Said amendment is appropriate in the R-6 zone district for several
reasons:
a, The R-6 zone district is the most intensive of residential zone
districts except the R/MF distri'ct, where dormitory use is
already designated as a conditional use.
b, R-6 zoning can generally apply to areas closer to the Commercial
Core, rather than more outlying residential areas of the City,
which areas are generally zoned less intensively.
c. The amendment has limited applicability in the R-6 zone district;
few sites are eligible for application of the Residential Bonus
Overlay in said distr~ct,
NOW, THEREFORE, BE IT RESOLVED by the Planning and Zoning Commission of
the City of Aspen that the following language changes to Section 24-10 of the
Zoning Code of the City of Aspen are recommended:
1. It is recommended that the R-6 zone district be deleted from Section
24-10,4(a),
2. It is reco~m~ended that the R-6 zone district be added to Section
24-10.4(b),
3. It is recommended that Section 24-10.5(b)(1) be amended with the
addition of the following language:
"To determine permitted density for a dormitory use, the total num-
ber of dormitory bedrooms proposed shall be divided by a factor
of six to establish an equivalent number of dwelling units."
4. It is further recommended that Section 24-10.4(b) be amended by the
addition of the following language:
"...provided that said dormitory use, when applied in the R-6 zone
district, complies with rental and sale price guidelines established
by the City of Aspen for restricted employee housing."
Approved by the Aspen Planning and Zoning Commission at its regular
meeting on March 3, 1981.
