COMMISSION CONCERNING THE GOLF COURSE
PROPERTIES CONCEPTUAL SUBDIVISION
Resolution No. 81 - 13
WHEREAS, at a special meeting on September 28, 1981, the Aspen Planning
and Zoning Commission did consider a conceptual application by the City of
Aspen to subdivide the City Golf Course into four distinct parcels, and,
WHEREAS, at the meeting the Commission did entertain the comments of
members of the general public, and
WHEREAS, on the basis of the information presented at the meeting the
Commission did determine that the proposed subdivision of two of the parcels for
the purposes of creating lots for key employees of the City of Aspen is an
inappropriate change in the use of land purchased with public funds for open
space purposes, and
WHEREAS, the basis of the Commission's finding of the inappropriateness of
the proposed subdivision includes the following considerations:
1. That Section 13.4 of the Home Rule Charter, entitled "Restriction on
sale of property" states that ~'Council shall not sell, exchange or
dispose of . . . public real property currently in use for public
purposes without first obtaining the approval of a majority of the
electors voting thereon."
2. That the piecemeal depreciation of open space without a comprehensive
analysis of the need for open space and the availability of future
open space is a poor approach to planning particularly in light of
the expected future pressure on existing open space for development
purposes.
3. That land which was originally dedicated as public open space should
not be used for employee housing purposes, but that instead, the City
should identify another site for the valid public purpose of housing
key city employees within or near the Ci. ty limits.
NOW, THEREFORE, BE IT RESOLVED by the Planning and Zoning Commission of
the City of Aspen that it does hereby recommend that City Council grant con-
ceptual approval to the Golf Course Properties Subdivision, subject to the
following conditions:
1. Elimination of lots 3 and 4 (proposed employee housing sites) from
the subdivision; and
2. Addition of a third parcel to the subdivision, to include the parking
lot which is adjacent to the Plum Tree Inn, which should properly be
part of the land zoned "Golf Course Support Overlay District" but
which should be left separate from the land to be sold to the future
developer of the Plum Tree Inn.
BE IT ALSO RESOLYED by the Planning and Zontn9 Comm!551on of the City
of Aspen that St does hereby tndi~ate to C~ty Council that should lots 3 and
4 (proposed employee h~ustng sites) be added back into the proposed subdtvi'sion,
then the Plann?ng and Zoning Co~nisston will deny this application at the
preliminary plat stage of review.
