HomeMy WebLinkAboutresolution.apz.003-79 RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION Re: Trash Access Code Amendments Resolution No. 79- _~ WHEREAS, the Aspen Planning and Zoning Commission have considered changes to the Aspen Municipal Code pursuant to publiC hearing with respect to trash access. NOW, THEREFORE, the Aspen Planning and Zoning Commission find certain amendments to the Aspen Municipal Code to be appropriate and recommend the following amendments thereto: 1. Amend Section 24-3.4 for the CC district, number (6) by changing the phrase, "covered by trash access area" to "utility/trash service area". 2. Amend Section 24.3-1, Definitions, to add (ee) Utility/trash service area: an area to be used only for public utility and refuse collection equipment. 3. Amend Section 24-3.7(h)(4) to read as follows: (4) Whenever this code shall require that a utility/trash service area be provided adjacent to an alley, buildings may extend to the rear property line provided that an open area be provided as follows. The area shall be accessible to the alley: For one or two lot development: a minimum length measured parallel to the alley of fifteen (15) feet and a minimum vertical clearance of ten (10) feet, and a depth of ten (10) feet is preserved on the ground level abutting the real lot line. For three to six lot development: the minimum length measured parallel to the alley shall be thirty (30) feet. All other dimensions, same as above. For six to nine lot development: the minimum length measured parallel to the alley shall be forty-five (45) feet. All other dimensions shall be as above. The provisions of this Section may be varied from by special review of the Planning and Zoning Commission pursuant to the provisions of Section 24-3.5(b). 4. Amend Section 24-3.7(e)(2) to exclude any covered utility/trash service areas from the calculations of F.A.R. in the CC or C-1 districts. 5. Amend Section 24-3.5, Special Review Criteria, by the addition of a new subsection which would read as follows:
