HomeMy WebLinkAboutresolution.apz.014-79RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION RECOMMENDING DENIAL OF THE CONDOMINIUMIZATION OF THE TIPPLE LODGE Resolution No. 79- /~/ WHEREAS, the owners of the Tipple Lodge which is located in the L-2 zone district have filed an application which requests subdivision exemption for the condominiumization of said Lodge, and WHEREAS, the Planning and Zoning Commission has heard evidence of the trend among particularly affluent condominium owners to remove their units from the short-term market and the Commission feels that it is imperative that all units in the Lodge zone continue to be available for short-term occupancy, and WHEREAS, the Commission is concerned that condominiumization would result in an undesirable change in the character of the Lodge zones by the elimination of the personal touch of a wide range of on-site rental and management services, and WHEREAS, the Commission is very definitely in favor of upgrading quality of Aspen's lodges which are located in the Lodge district or in other districts and have formed a committee to investigate methods for accomplishing this goal, and WHEREAS, the Commission is of the unanimous opinion that the condominiumiza- tion of lodges is not in the community interest and are therefore in favor of a prohibition against the condominiumization of lodges. NOW, THEREFORE, BE IT RESOLVED that the Aspen Planning and Zoning Commission does hereby recommend denial of the subdivision exemption for the condomiumization of the Tipple Lodge for the following reasons: 1. The Commission believes condominiumization would be detrimental to the tourist housing supply in that it opens the possibility for reducing 4. Condominiumization would reduce the lodge aspects of the property by disintegrating management, reservations, maintenance, and other beneficial services, and 5. The Commission believes that condominiumization would create immediate pressures for the different owners to go in different directions with regard to rental price, use, management, and 6. The Commission believes it to be impossible to create an agreement or restrictive covenant which is a sufficient guarantee against the possible abuses envisioned, and 7. A potential reductiQn in the supply of lodge units in the Lodge district place additional pressure on surrounding residential zones for lodge development.
