HomeMy WebLinkAboutresolution.apz.018-79 P~ESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION RECOMMENDING THAT NO CHANGE BE MADE TO THE PERMITTED USES OF THE L-1 ZONE Resolution No. 79- ~ WHEI{EAS, the Aspen Planning and Zoning Commission held a public hearing on Tuesday, September 18, 1979, to consider an amendment to the permitted uses within the L-1 zone district to allow single family, duplex and multi-family uses as permitted uses within that zone, and WHEREAS, the Commission heard testimony from the Planning Office and from the general public concerning the implications of this amendment, and WHEREAS, the Commission is sympathetic to the problems of Richard Sahbatini, who requested the Aspen City Council to initiate this code amendment, and WHEREAS, the Commission has been concerned for some time about the up-grading of lodges and is interested in solving this concern by a more direct manner than amending the Code, NOW, THEREFORE, BE IT RESOLVED by the Aspen Planning and Zoning Commission that it does hereby recommend to the Aspen City Council that no change be made to the permitted uses of the L-1 zone district for the following reasons: 1. The Commission feels that it is unwise to change uses in a zone for one piece of property. 2. The Commission feels that it is better to handle the proposed expansion and up-grading of non-conforming uses through a non-conforming preservation clause and/or housing overlay that is presently being worked on by the Commission. 3. The Commission also feels that this proposed amendment would open the way for the condominiumization of lodges by making multi-family uses a conforming use and thus creating separate ownerships and reducing the lodge inventory in the very area where it should be concentrated.
