TIPPLER TOWN HOMEs/T IPPLE LODGE (RESIDENCES AT LITTLE NELL)

SUMMARY:
Vann Associates, LLC, on behalf of the applicant Aspen Land Fund, LLC, requests a six (6)
month extension of the deadline for filing the final subdivision documents for the Tipple
Lodge/Tippler Townhomes (Residences at Little Nell), from December 20, 2004 until June 20,
2005 - The reason for the extension request is to allow the applicant sufficient time with which to
process, finalize and submit to the City the final recordation documents for the Residences at
Little Nell, which have received final PUD approval by the City Council.

REVIEW PROCEDURE:
The Community Development Director, pursuant to Land Use Code Section 26.445. 100, Planned
Unit Developments, may approve insubstantial amendments to an approved PUD.
BACKGROUND:
The Tipple Lodge was approved by City Council on June 23, 2003 (Ordinance No. 23, Series of
2003) with a condition that the final subdivision documents (the plat and the subdivision
agreement) be recorded with the Pitkin County Clerk and Recorder within 180 days, or by
December 20, 2003. While the applicant had this approval in place, it simultaneously processed
and received approval by the City Council for a Conceptual PUD for another project on a portion
of the same site. That project, the Residences at Little Nell, was the applicant's preferred project
for the site and it consequently submitted a final PUD approval in order to construct it. Realizing
that the review process for the final PUD would likely extend well beyond the initial December
20, 200' ) deadline that was set to record the subdivision documents for the Tippler Lodge, the
Applicant applied for, and was granted, an insubstantial amendment that pushed the deadline out
a full year to December 20, 2004.

STAFF FINDINGS AND RECOMMENDATION: finalize and submit to the

I hereby approve this Insubstantial Amendment to the Tipple Lodge/Tippler Townhomes
(Residences at Little Nell) PUD allowing for an extension of the recordation deadline for the
project for a period of six (6) months, out to June 20, 2005, finding that the request has been
made within -the vesting timeline and that there is a viable cornalurlity interest for such an
extension.

Condominiums), Request for Extension of Recordation Deadline
Dear Chris:
Please consider this letter a formal request to extend the recordation deadline for the
final subdivision documents for the Tipple Lodge/Tippler Townhomes properties, a
free market residential/affordable housing project which is also referred to as the
Tippler Townhome Condominiums. The request is submitted pursuant to Section
26.480.080.E. of the City's Land Use Regulations by Aspen Land Fund, LLC, the
owner of the two properties. This section of the Regulations permits the Community
Development Director to extend the recordation deadline if the request is within the
vesting timeline and there is a community interest for approving the extension.
The final subdivision documents for the Tipple Lodge/Tippler Townhomes properties
were to have been recorded within 180 days of the receipt of final City Council
approval. Final approval was granted by the City Council on June 23, 2003 pursuant
to Ordinance No. 23, Series of 2003. Consequently, the project's final plat and
subdivision agreement were to have been recorded no later than December 20, 2003.
This deadline, however, was extended by Julie Ann Woods at the owner's request
until December 20, 2004 (see enclosed Notice of Decision).
As you know, Aspen Land Fund has received final PUD approval for the Residences
at Little Nell, a timeshare lodge project which is the preferred development scenario
for the properties. Aspen Land Fund is in the process of finalizing the recordation
documents for the Residences and expects to submit them to the City for review and
recordation early next year. As the review of the Residences documents will undoubt-
edly take several weeks to complete, Aspen Land Fund respectfully requests that the
recordation deadline for the Tippler Townhome Condominiums project be further
extended. The previously approved residential project is vested until June 23, 2006,

and no apparent community benefit would appear to result from the recordation of its
final plat at this time. Please note that the subdivision/PUD agreement for the
Residences at Little Nell will abandon the prior Tippler Townhome Condominiums
approval.
To accommodate the recordation process for the Residences at Little Nell, Aspen
Land Fund requests that the recordation deadline for the Tippler Townhome Condo-
miniums project be extended for an additional 180 days. The revised deadline,
therefore, would be June 20, 2005.

SUMMARY:

extension of the deadline for filing the final subdivision documents for the Tipple Lodge/Tippler

Townhomes, from December 20, 2003 until December 20, 2004. The reason for the extension
request is to allow the applicant sufficient time with which to process a Final PUD application
for an alternative project on the site, known as the Residences at Little Nell.
BACKGROUND:
The Tipple Lodge was approved by City Council on June 23, 20031 (Ordinance No. 23, Series of
2003) with a condition that the final subdivision documents (the plat and the subdivision
agreement) be recorded with the Pitkin County Clerk and Recorder within 180 days, or by
December 20, 2003. While the applicant has this approval in place, they simultaneously
processed and received approval by the City Council for a Conceptual PUD for another project
on a- portion of the same site. The project — the Residences at Little Nell — is the applicant's
preferred project for the site and they plan to soon submit for a Final PUD approval in order to
construct that project. The review process for the Final PUD will likely extend well beyond the
December 20, 2003 deadline to record the subdivision documents for the Tippler Lodge. If that
project is not approved the applicant would like to construct the Tipple Lodge/Tippler
To,Arnhomes approval, thus, they need to remain in compliance with all of the requirements of
that approval. According to the applicant recording the final subdivision documents for the
Tipple Lodge project prior to knowing the outcome of the Final PUD forthe Residences at Little
Nell would be premature and not in the community's interest and that is why they are requesting
the one-year extension.
STAFF COMMENTS:
According to Section 26.480.070(E) of the Land Use Code, the Community Development
Director may extend the recordation deadline if the request is within the vesting timeline and if
there is a -community interest for providing such an extension. The Community Development
Director may forward the extension request to the Planning and Zoning Commission.
STAFF FINDINGS:
The staff finds that the request for extension for recording the final subdivision documents for
one year is appropriate and that the Community Development Director may sign off on the

request. The primary reason for the granting the extension is so that the applicant will have time
to process the Final PUD application for the Residences at Little Nell. Staff believes that a
legitimate community interest i's served here, 'in that we feel the Residences is a better project for
the community. The mixed use, timeshare project will serve to revitalize the area in which its
located and attract additional visitors to the community, whereas the Tipple Lodge/Tippler
Townhomes proposes a low density townhome project that will add very little to the community
in terms of increasing the economic activity and vitality.
COMMUNITY DEVELOPMENT DIRECTOR APPROVAL:
I hereby extend the recordation deadline for the Tipple Lodge/Tippler Townhomes project for
one-year, which will now expire on December 20, 2004, finding that the request has been made
within the vesting timeline and there is a-comniunity interest for providing such an extension.
