HomeMy WebLinkAboutresolution.apz.006-76 RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION RECO~4ENDING VARIOUS CHANGES TO TtIE ASPEN ZONING CODE WHEREAS, the Aspen Planning and Zoning Commission has, during the past several months, examined the elements of the office zoning districts within the City of Aspen, and WHEREAS, the Commission, in its resolution dated April 2, 1976, recommend the merging of the Office (O) and Office Two (02) districts into one Office (O) District, and recommended further modifications to the area and bulk require- ments in this district, and WHEREAS, the Resolution dated April 2,-1976, was by Resolution dated July 20, 1976, further amended with respect to the area and bulk requirements of the O Office District, and WHEREAS, the Commission has been presented with further amendments to the components of the O Office District, and has given proper notice of and conducted a public hearing on said recommended changes, at its meeting held August 17, 1976, and WHEREAS, the Commission is required by virtue of Section 24-11.3(d) of the Aspen Municipal Code to, subsequent to such public hearing, report and recommend to the City Council on the proposed changes, and WHEREAS, Section 24-11.7 provides that if the Commission shall affirmatively recommend changes to the map or code, and do so by resolution, such recommendations shall have an interim effect, all as further described in said section, and WHEREAS, the Commission wishes to make known its recommendations with respect to every change proposed, and to formalize its report by resolution such as to enjoy the effects of Section 24-11.7, NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF ASPEN, COLORADO, That it does affirmatively recommend that Sections 24-3.2, 24-3.4, and 24-4.5 of the Aspen Municipal Code be amended so as to establish the following as permitted and conditional uase, and area and bulk and parking requirements for the 0 office District within the City of Aspen, Colorado. Section 24-3.2 Permitted and Conditional Uses INTENT - To provide for the establishment of offices and associated commercial uses in such a way as to preserve the visual scale and character of formerly residential areas that now are adjacent to commercial and business areas and along Main Street and other high volume thorough- fares.. PE~4ITTED USES - Single family duplex and multi-family res- idences; professional and business offices, accessory buildings and uses; accessory dwelling units recognized in an approved housing plan by special review of the plan- ning commission. CONDITIONAL USES - Fraternal lodges, boarding houses, shop craft industry, restaurants, antique store, furniture store, bookstore, florist, visual arts gallery, music store, (for the sale of musical instruments), nursery-day care center, art, dance and music studio, mortuary; provided, hawever, that conditional uses shall be considered (1) only for structures which have received historic designation, (2) for no more than two such conditional uses in each structure (not including within such limitation accessory dwelling units recognized in an apprived housing plan), and (3) only when off-street parking is provided with al- ley access for those conditional uses along Main Street. INTERNAL FLOOR AREA No requirement Section 24-4.5(c) Off- street Parking Requirements That the parking requirements for the O and 0-2 office districts be repealed and that there be established the following off-street parking requirements for the newly established 0 Office District. Fewer spaces can be permitted by special review (SR) by the Planning and Zoning Commission but no less than 1.5 spaces per 1000 sq.ft. Any recommendations herein contained which are incon- sistent with previously made and pending recommendations of this Commission shall supercede such inconsistent recommendations to -3- the extent of any such inconsistency only.
