Minutes of September 9, 1992
Meeting was called to order by chairman Bill Poss with Don Erdman,
Jake Vickery, Roger Moyer, Karen Day, Martha Madsen and Linda
Smisek present. Joe Krabacher and Les Holst were excused.
COMMISSIONER COMMENTS
Jake: The city Hall remodel is not sympathetic historically, it
is your basic routine modern remodel. I would hope that the
committee would make a statement that prime historical landmark
buildings be done more sympathetically in the interior as well as
preserving the outside.
Roger: A letter needs to be sent to the City Manager with our
concerns.
Bill: I would like to direct Staff to prepare a letter that I will
sign to the City Manager. The Court House remodel is exceptional.
MOTION: Don made motion to move Old Business on the agenda to the
end of the meeting; second by Linda. Ail in favor, motion carries.

Roxanne: A vital letter that is required was missing in the
application and that is why this is a worksession. The memo
attached in your packet is a worksession memo not a full review.
This would be a minor development but Staff has not commented
fully.
Dick Fallin, architect: We would like to proceed as this being a
real meeting even though the letter was not submitted on time.
Roxanne: Basically they want to do less than the Kaplan plan. A
minor development does not require a public notice, but a full
review by the Board.
Bill: For the record I have met with Roxanne and the applicant and
the architect under the stream line process so I am familiar with
the application.
Bill: I would suggest to the committee that we allow the applicant
to submit a detailed presentation and at the end we can establish
whether we feel comfortable with the changes.
APPLICANT PRESENTATION
Dick Fallin, architect: The revision of the model visualizes what
is happening. The primary changes occur on the rear of the
building. There will be no changes to the existing facade on the

street side other than painting and repairing the brick. A crested
fence will be added on the roof which was approved before. The
wall facing the courtyard will be moved out. The sweitzer cottage
has window changes.
Roger: The direction for lot 2 is a park.
Bruce Berger, applicant: The preliminary plan is
restriction so that the land would remain green space.

Roger: A passive park similar to Hillard Park.
Dick Fallin: Under the Kaplan plan there is an existing four car
garage building across the alley. Under that plan the building was
removed entirely from the site and the connecting room attached to
the building was to become a three car garage. We were therefore
able to transfer the floor area into the remaining part of the
house and in this scheme we are raising the entire house and
digging a basement with two or three bedrooms, family room bath
etc. The existing wooden fence that is there now was taken down
and new brick piers were approved with a wood fill fence inside and
height established under conditions of approval and still are.
There would be a roof deck. One of the dormers was changed from
a window to a door to get to the deck. We will reside the garage
and reroof. There will be steps that go down to an existing patio.
Regarding the fence Mr. Berger would like you to consider the wood
infill and change it to brick infill. Keeping the brick piers and
spacing them the same. The pool is existing and will remain. All
the terracing will be changed. There will be a large existing
dormer taken out and replaced with two smaller dormers.
Linda: How are you going to deal with the leakage on a flat roof?
Dick Fallin: We will reroof and put in roof drains. We will put
in a gutter over the front door. All sidewalks will be snow
melted. We are not going to exceed any FAR or the existing site
coverage. Some of the variance that were approved for setback are
still valid and some of those we will not need anymore.
Bruce Berger: If the park goes through we would like a "green
fence" to come around so that the two lots are separated for
privacy. The house will be a private residency.
Karen: On the plan what is the purpose of raising the window ceil.
Dick Fallin: Our concern is having room for curtains and
furniture. This is an addition.
Roger: I recall that the fence was not to connect to the house and

have a slight opening. And that the fence would in fact be brick
to go along with the structure. Les brought up the concept if you
walk down the street you have a wall and that at intervals there
would be an opening. It could be grill work, greens or whatever
to make it somewhat transparent but private. That was left to be
worked out with the project monitor.
Jake: What was happening with the garage in the Kaplan plan?
Dick Fallin: The garage would be removed entirely and a caretaker
unit but he withdrew his application. We are asking for no
additional FAR.
Roger: I feel this is an excellent presentation with the model as
an exhibit. Regarding light wells we had done a tour around town
and the best light well are those that are graduated down. It
opened it and gave you the impression that it wasn't just a hole.
We want to encourage applicants to terrace light wells.
Dick Fallin: In the Kaplan plan there was a lot of structural work
entailed and we feel our plan has a less obtrusive effect.
Don: This is a marvelous opportunity to get something much better
than what we approved. I feel this is a minor development.
Roxanne: The skylights project up six to nine inches and are not
on the model; does the board feel comfortable with them.
Roger: The brick wall should not read as a solid wall.
Bill: The model presented made it much clearer for us to
understand.
MOTION: Don made the motion that the revisions to the approved
vested plan for Pioneer Park Lot 1 Weaver Subdivision and letter
dated August 27, 1992, and landscape plan dated September 2, 1992
be approved subject to final elevations and details of the brick
perimeter wall surrounding the garden and pool area. All financial
obligations which were required under the previous approval will
still remain in effect; second by Roger. All in favor, motion
carries.
Linda: I have a concern about the security of the patio if a park
goes in. People in the park using it.
Bruce Berger: The plan shows a continuous hedge which hides the
depression.
Roxanne: There will also be a wrought iron fence partially around.

It is anticigated that there will be certain hours that the public
could use that area although we have not talked about the details
of that.

Don opened the public hearing.
Roxanne: At the last meeting you allowed a deck off the out
building of no more than 50 square feet providing there were no
encroachments. The public hearing was continued until today due
to the variations of height which is allowed in the cottage infill
unit. You don't have to make a compatibility finding for the
height increase and also for the side yard setback.
Kathy: The next door neighbor came in after the last meeting and
said as long as they were within the setbacks that she would feel
comfortable with the deck. She also stated that she would prefer
not to have the deck at all.
Roxanne: The height variance I still recommend. I do no think the
height change is any more significant than the other changes. If
the outbuilding was staying very clean I would have more concern.
The character of the outbuilding has been changed.
Jake: We put the stakes up.
Don: The committee hasn't determined whether to approve the height
variation for interior use.
Jake: There are two things for the increase in height one is to
get more height for the accessory dwelling unit to change the use
of the upper floor which is allowed in the cottage infill program.
Martha: It will not project up any higher than the house behind.
Karen: By raising the center twelve inches we save the interior
of the wonderful roof. Otherwise we loose everything inside and
out.
Roxanne: I feel it is worth the 12 inch variation.
MOTION= Karen made the motion that the HPC allow for the height
variation of not more than twelve inches for the alley building for
roofing purposes in order to preserve the original roof interior
of the cottage and also that any sideyard or rear yard
encroachments are denied; second by Linda. All in favor, motion
carries.
