SUMMARY:
Patricia and Llwyd Ecclestone, represented by Keith Howie, has applied for an insubstantial
amendment to the approved Aspen Highlands Village Subdivision/PUD to amend the
approved building and activity envelopes on Lot 4, Block G, of the Aspen Highlands Village
Subdivision/PUD. Specifically, the Applicants are requesting the ability to add a triangular
piece of land to the activity and building envelopes on the north-western edge of the existing
building envelope as can be seen in the draft plat attached as Exhibit `B". Additionally, the
Applicants have requested to remove some area of land from the existing activity envelope
on the north-eastern edge of the existing activity envelope and reconfigure the north-eastern
edge of the building envelope as also is shown on the draft plat attached as Exhibit `B".

REVIEW PROCEDURE:
The Community Development Director, pursuant to Land Use Code Section 26.445.100,
Planned Unit Developments, may approve insubstantial amendments to an approved PUD.
STAFF COMMENTS:
In reviewing the request, Staff believes that the proposal is consistent with the City's internal
building envelope adjustment policy guidelines. The Applicants have obtained approval
from the Aspen Highlands Village Design Review Board (please see Exhibit "C") for the
proposed change and are not increasing the overall size of the building envelope or activity
envelope as is required by the City's policy for approving a building envelope adjustment
administratively. The City of Aspen Parks Department has also reviewed the proposed
amendment and has indicated that they do not believe that approving the request will allow
for any greater disturbance of natural vegetation than if the existing building and activity
envelopes were to remain in affect.
RECOMMENDATION:
Staff feels that the proposal meets the requirements for approving an insubstantial
amendment to an approved PUD and recommends that the Community Development
Director approve with conditions, this Insubstantial PUD Amendment to allow for the
proposed building and activity envelope adjustments on Lot 4, Block G, Aspen Highlands
Village Subdivision/PUD.
APPROVAL:
I hereby approve this Insubstantial Amendment to the Aspen Highlands Village

Review Criteria & Staff Findings
Insubstantial PUD Amendment.
An insubstantial amendment to an approved development order for a final development
plan may be authorized by the Community Development Director if the following review
standards are met.
1. A change in the use or character of the development.
Staff FindinLY:
The use and intensity for Lot 4, Block G, of the Aspen Highlands Village
Subdivision/PUD remains the same as approved by the original PUD. Staff does not
believe that the amendment changes the character of the development in a way which
necessitates review by the Planning and Zoning Commission or City Council. Staff finds
this criterion to be met.
2. An increase by greater than three (3) percent in the overall coverage of structures on
the land.
Staff Finding:
The proposed building envelope adjustment will not increase the coverage of structures
within the PUD. Additionally, the amended building envelope and activity envelope will
contain the same amount of square footage as the existing building and activity
envelopes. Staff finds this criterion to be met.
3. Any amendment that substantially increases trip generation rates of the proposed
development, or the demand for public facilities.
Staff Finding:
Trip generation and demand for public infrastructure are not affected by this change.
Staff finds this criterion not to be applicable to the proposed amendment.
4. A reduction by greater than three (3) percent of the approved open space.
Staff Finding:
The amount of open space within the PUD will not be reduced by the proposed building
envelope adjustment. The amended building envelope and activity envelope will be the
same size as the existing building and activity envelopes. Staff finds this criterion to be
met.
S. A reduction by greater than one (1) percent of the off-street parking and loading
space.
Staff Finding:
The Applicants are' not requesting an amendment to the existing or required number of
parking spaces. Staff finds this criterion not to be applicable.
6. A reduction in required pavement widths or rights -of -way for streets and easements.
Staff Finding:
The Applicants are not proposing changes to right-of-way widths. Staff finds this
criterion not to be applicable.
7. An increase of greater than two (2) percent in the approved gross leasable floor area
of commercial buildings.
Staff Finding:
The Applicants are not proposing changes to a commercial building. Staff finds this
criterion not to be applicable.
8. An increase by greater than one (1) percent in the approved residential density of the
development.
Staff Finding:
The Applicants are not proposing a change in the residential density. Staff finds this
criterion not to be applicable.
9. Any change which is inconsistent with a condition or representation of the project's
original approval or which requires granting a further variation from the project's
approved use or dimensional requirements.
Staff Finding-
The proposed amendment is consistent with the project's original approval. Additionally,
the Applicant is not requesting a variance from the approved use or dimensional
requirements on the lot. Staff finds this criterion to be met.

Llwyd Ecclestone III and Tricia Ecclestone ("Applicant"), as owner of Maroon Lot 4 Aspen
Highlands, Aspen, Colorado have approached the Design Review Board of the Aspen Highlands
Homeowner's Association with a request to modify the Lot 4 building and activity envelopes as
depicted on the attached site plan. Keith Howie of Keith Howie & Associates represents the
Applicant.
The Design Review Board of the Aspen Highlands Homeowners Association and the adjacent lot
owners reviewed this request and find the proposed modification to be acceptable based on the

James, I reviewed the lot today and found these items of importance. The lot 'is heavily treed and in
either scenario the impact will be great. So I am not concerned with the request for the change in the
envelopes and activity envelope. However the developer and the owner must agree that the entire
activity envelope will be fenced off at all times and that access to the construction area will only be
reached from the road side of the lot not around the lot. There will be no variances or reasons to disturb
the areas outside of the activity envelope.

Please make the following modifications to the proposed plat:
1. Include a vicinity map.
2. Use 4 different line types to identify the proposed and existing
building envelopes, as well as the proposed and existing development
envelopes. Also, please more clearly label the existing and proposed
envelopes.
3. Change the Community Development Engineer's signature block to
the City Engineer's signature block.
4. Describe a true point of beginning that is tied to a government
monument.
5. Obtain all signatures with the exception of the City Community
Development Director, City Engineer, and Pitkin County Clerk and
Recorder prior to submitting two (2) mylar copies to the Community
Development Department. A recording fee of $11 (payable to Pitkin
County Clerk and Recorders) is due upon submittal of the mylars.

CITY OF ASPEN (hereinafter CITY) and KEITH HPWI�i f _ p OGld�i�� � TaT►y6�
(hereinafter APPLICANT) AGREE AS FOLLOWS:
1. APPLICANT has submitted to CITY an application for

(hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that City of Aspen Ordinance No. 38 (Series of 2004)
establishes a fee structure for Land Use applications and the payment of all processing fees is a condition precedent
to a determination of application completeness.
3. APPLICANT and CITY agree that because of the size, nature or scope of the proposed project, it
is not possible at this time to ascertain the full extent of the costs involved in processing the application.
APPLICANT and CITY further agree that it is in the interest of the parties that APPLICANT make payment of an
initial deposit and to thereafter permit additional costs to be billed to APPLICANT on a monthly basis.
APPLICANT agrees additional costs may accrue following their hearings and/or approvals. APPLICANT agrees he
will be benefited by retaining greater cash liquidity and will make additional payments upon notification by the
CITY when they are necessary as costs are incurred. CITY agrees it will be benefited through the greater certainty
of recovering its full costs to process APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete
processing or present sufficient information to the Planning Commission and/or City Council to enable the Planning
Commission and/or City Council to make legally required findings for project consideration, unless current billings
are paid in full prior to decision.
5. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to collect
full fees prior to a determination of application completeness, APPLICANT shall pay an initial deposit in the
amount of $ 4 DW 00 which is for '0 hours of Community Development staff time, and if actual
recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings to CITY to reimburse
the CITY for the processing of the application mentioned above, including post approval review at a rate of $210.00
per planner hour over the initial deposit. Such periodic payments shall be made within 30 days of the billing date.
APPLICANT further agrees that failure to pay such accrued costs shall be grounds for suspension of processing, and
in no case will building permits be issued until all costs associated with case processing have been paid.
