HomeMy WebLinkAboutminutes.boa.20050915 ASPEN BOARD OF ADJUSTMENT MEETING MINUTES September 15,2005 Rick Head opened the Special Board of Adjustment Meeting in Council Chambers at 4pm with members Peter McClain, Mark Hesselschwerdt and Elizabeth Atkins present. Charles Paterson and Jag Pagnucco were excused. Staff in attendance were: David Hoefer, Assistant City Attorney; Sarah Oates and Chris Bendon, Community Development; Jackie Lothian, Deputy City Clerk. PUBLIC HEARING: CASE #05-04. APPEAL OF AN ADMINISTRATIVE DECISION REGARDING THE SETBACK FOR LOT 1. BLOCK 3, ASPEN GROVE SUBDIVISION Rick Head opened the appeal hearing and stated that only 4 Board of Adjustment members were present and asked if the parties wished to proceed. Joe Edwards, attorney for the appeal, said that he would rather wait for a full compliment. Herb Klein, attorney for property owners and would like to hold for a full board also but for the record they are being held up by pending the outcome of the appeal. Klein submitted a letter into the record that questioned if the board had jurisdiction to hear the appeal because the code has a provision for appeals of these natures can be made by the person who requested the determination but there was no mention of appeal by a member of the general public; the appeal was only vested in the person requesting the interpretation. David Hoefer suggested that the attorneys meet prior to the next hearing. MOTION: Mark Hesselschwerdt moved to continue the appeal hearing to September 29, 2005; seconded by Peter McClain. All in favor, motion carried. CASE #05-02. REQUEST FOR A TWENTY (20) FOOT FRONT YARD SETBACK VARIANCE FOR THE CONSTRUCTION OF A SINGLE- FAMILY RESIDENTIAL DWELLING UNIT AND A THIRTY (30) FOOT FRONT YARD SETBACK VARIANCE FOR THE PROPOSED DRIVEWAY AND ASSOCIATED RETAINING WALLS FOR LOT 1. BLOCK 3, ASPEN GROVE SUBDIVISION, WARREN MAPLE, LLC AND DAVID MAPLE, LLC. MOTION: Elizabeth Atkins moved approve the minutes from June 9th, July 14th and August 18th; seconded by Peter McClain. All in favor, motion carried. 1
