Mayor Edel called the meeting to order at 12:10 p.m. with Councilmembers Van Ness, Isaac,
Parry, and Michael present. Also present were City Manager Chapman and City Attorney
Stock. The purpose of the meeting is to read a resolution setting the special election
so that it can be held February 26, 1980.
Councilman Isaac moved to read Resolution #24, Series of 1979, by title; seconded by
Councilwoman Michael. All in favor, motion carried. Reso. 24, 1979

A RESOLUTION CONCERNING TWO QUESTIONS TO BE SUBMITTED TO A VOTE OF THE
QUALIFIED ELECTORS OF THE CITY OF ASPEN, COLORADO, AT A SPECIAL MUNICIPAL ELECTI£
TO BE HELD ON TUESDAY, THE 26th DAY OF FEBRUARY, 1980; DIRECTING THAT THE
QUESTIONS BE SUBMITTED OT THE QUALIFIED ELECTORS OF THE CITY FOR APPROVING
OR REJECTING A PROPOSED AMENDMENT TO SECTION 10.5 OF THE CHARTER OF THE CITY
OF ASPEN RELATING TO THE ISSUANCE OF REVENUE BONDS PAYABLE FROM THE PROCEEDS
OF THE REAL ESTATE TRANSFER TAX OF THE CITY, AND THE QUESTION OF ISSUING
GENERAL OBLIGATION PUBLIC HOUSING BONDS IN THE PRINCIPLA AMOUNT NOT EXCEEDING
$4,000,000; SETTING FORTH THE PROPOSED AMENDMENT AND THE BALLOT QUESTIONS;
PROVIDING FOR THE PRECINCT AND POLLING PLACE; AND SETTING FORTH OT~HER DETAILS
IN REGARD TO SUCH ELECTION was read by the city clerk.
Councilwoman Michael moved to adopt Resolution 924, Series of 1979; seconded by Councilmar
Isaac. Councilman Isaac asked if there would be a public hearing. City clerk Koch said
that Ordinance ~89, containing the same information, would have a public hearing. All
in favor, motion carried.
Councilwoman Michael moved to adjourn at 12:15 p.m.; seconded by Councilman Van Ness.
All in favor, motion carried.

Special Meeting Aspen City Council December 27, 1979
Mayor Edel called the meeting to order at 12:10 p.m. with Councilmembers Behrendt, Isaac,
Michael, Parry,~ and Van Ness~ Alsopresent wereCity Attorney Stock and City Manager Chapman.
Councilwoman Michael told Council she wanted to reconsider the ordinance that would allow
extension from the growth management plan deadline. Councilwoman Michael moved to recon-
sider Ordinance ~84, Series of 1979; seconded by Councilman Van Ness. All in favor, Ord. 84, 1979
motion carried. Reconsideration

City Attorney Stock submitted a redraft of this Ordinance with the notice of special extension
meeting; this redraft divides dwelling units into employee and free market units. This
says the free market units may be built anytime; these can be delayed but the employee
units have to be built. This is discretionary on Council's part and opens an extension
up for consideration. Councilman Van Ness pointed out this is all based on an orderly
growth plan. Now Council is saying that growth may all occur at once. People could sit
on their allotments; Councilman Van Ness said he felt there should be a time limit on
everything. Stock pointed out now if one has an allocation and a building permit is not
gotten in two years, the allocation lapses and it is added back into the quota. Council-
man Parry said with a limit, it will force these units to be built. Without a limit, the
city may not see the free market units, but will get the employee units. Councilman
Isaac said he feared without a limit, this will be getting into developing a futures
market for the free units in Aspen. Councilman Van Ness said he felt it was important
that new lodging be built as opposed to the allotment sitting around forever. The lodgin~
is important to Aspen's economy. Councilman Van Ness said he would go with a 4 year
limit.
City Attorney Stock suggested setting a 2 year limitation on everything except the free
market dwelling units, which would have 5 year limitations. Failure to obtain a building
permit within that time period will require the allotment to expire automatically. Stock
said he would give Council the right to grant an extension on showing of good cause. Any
expired allotments will be added back to the quotas. If within 2 years, the employee
units are nog built, then the free market expires.
Councilman Behrendt moved to amend Ordinance 984, Series of 1979, to read free market
units building permit must be obtained within 4 years of its being awarded an allotment
and if there is a project which is approved joint free market and deed restricted housing,
if the deed restricted allotment expires, the whole project expires; seconded by Council-
man Isaac.
