Regular Meeting
Historic Preservation Committee
September 23, 1975
Meeting was called to order by Chairman Groen at 1:05 p.m. with members Norman
Burns, Florence Glidden and Mona Frost. Marsh, End and Michael were excused.
Also present were Clayton Meyring and John Stanford.
Approval of Minutes Burns moved to approve the minutes for September 9 & 16, 1975,
Mrs. Frost seconded. All in favor, motion carried.
Old Business
Groen noted that Tom Mix had requested to be added onto
the agenda for today.
Motion
Burns moved to add Tom Mix to the agenda. Mrs. Frost
seconded. All in favor, motion carried.

Groen explained that they had tabled the motion from last
meeting with the hope that applicant would consider putting
the stairs inside. He noted that they had considered ~4 & 5
of the criteria as their basis for the action. %4 says "No
new construction or remodeling shall have exposed structural
skeletal elements other than load bearing walls." %5:
"Porches and stoops shall not exceed 20 feet along any facade
Balconies shall not project beyond the building facade."
Walter Birk and Frank Woods, co-master leasees of the Tom
Mix building, noted that since their taking over the building
three years, they have made all the improvements to the
building. Wally Birk said that the stairs coming from the
rear would enhance the safety and financial aspects of the
venture. He noted that they had started the process 2½ years
ago and received a Board of Adjustment variance on the
open space. They had ruled out a front stairs and requested
it not be enclosed. He noted the problems they had with
bringing the building up to fire code. They had also gone
to the Board of Appeals for the fire code problems since
they didn't have four-hour fire walls, and the Appeals Board
said it must be of heavy timbers. He said that they had
cooperated with each Board. Mr. Birk said that they would
try and make the area aesthetically nice with a brick
fountain, gas lights and a "New Orleans" character. Burns
asked what was upstairs in the building with Birk saying it
was five apartments with the Tom Mix part being a split-
level type of arrangement. Stanford had prepared a memo
from the Planning Office which was submitted to the HPC.
Stanford said that he felt the arcade would be too enclosed
to be open space. Burns asked why it couldn't be put inside
with Birk noting that Tom Mix has a lease that they have
no control over. Groen felt that they should be able to
carry the balcony to the stairs in the rear but Birk said
it was against the fire code.
Motion
Burns moved to deny preliminary request based on $4 & 5 of
their criteria, the stairs were not required now by the
applicant, and the Planning Office memo. Mrs. Glidden
seconded. All in favor, motion carried.
Stanford explained to Birk that this was preliminary review
and now a public hearing will be set for final review.
Birk asked for specific reasons why he was denied and was
given a copy of the criteria on which $4 & 5 were circled.
Birk questioned the legal implications of the public hearing-
if there were many people favorable to the stairs present
at the hearing, would they have to consider them? Stanford
replied in the affirmative. Meyring said that he felt it
was possible for them to put the stairs inside but that they
did have the open space variance for the stairs. Mrs. Frost
asked that secretary provide them with copies of the minutes

from both the Board of Appeals and Board of Adjustment
meetings concerning Tom Mix. Members decided to have the
public hearing published for October 28th due to lack of
quorum before that time. They also scheduled an on-site
inspection for October 21st before the joint public hearing
on the four structures with P & Z.
Don Fleisher was present with mock-ups of colors he has
selected for the front of the Arcades building. He noted
that he had decided on frosted glass instead of mirrored
and that there would be no other signage on the front except
for the one in large gold leaf telling the name of the
building. He would have small gold Aspen leaves down the
sides and oval shaped doors inside. Colors presented were
purple, red (door), and orange on top. He said that what
he hoped to do was order a gallon of each color and paint
one panel to see if its really the effect he wants. Groen
questioned how this would look next to Ute City and Pitkin
County Dry Goods since both were sober brick. He felt that
what was needed was something brighter. Groen reminded him
that they had turned down purple on another building and
asked if Fleisher couldn't go with more earth tones since
purple was not a Victorian color. Fleisher asked that they
meet with his graphic artist who will be in town on October
21st. Members decided to have a special meeting at 4:00 p.m.
on the 21st. Groen asked that the Mayor be given a copy
of these preceedings. Also Ms. Stuller was to be notified
about the public hearing.
Burns moved to adjourn with Mrs. Glidden seconding. Ail
in favor, meeting adjourned at 2:35 p.m.
