HomeMy WebLinkAboutminutes.hpc.19741206RECORD OF PROCEEDINGS 100 Leaves Regular Meeting Historic Preservation Ccmmittee December 6, 1974 Meeting called to order at 2:20 p.m. by Vice-Chairman Lary Groen with members Mona Frost, Jerry Michaels, and Norm Burns. Terry End was excused. Also present was Greg Cole from the Planning Office. ELECTION OF OFFICERS APPROVAL OF MINUTES Secretary opened the meeting and called for nominations for Chairman and Vice-Chairman. Michaels nominated Groen for Chair- man and Burns for Vice-Chairman. Frost seconded. Burns noted that the problem might be that both will be gone at the same time and Frost thought that the Secretary would then appoint a Chairman for that meeting. All in favor, motion carried. Groen asked if there were any corrections to the minutes of Nov. 8 and 15 and Burns noted that there was a misspelling of the word ~laque and he also noted that the correct spelling of Shoe- maker is "Schuhmacher". Motion Burns moved to approve the minutes as corrected and Michaels seconded. All in favor, motion carried. PUBLIC HEARING discussion Burns said that according to the paper Council would be hearing the Historic District Ordinance the following Monday but it was determined that it was not scheduled on the agenda for that day. Groen said that in case it was going to be on, would all the members be able to attend? Frost said she could after six o'clock and Burns thought it would be a goood idea if Michaels would say a few words, too. Members thought that there should be as many people as possible that are in favor of the district at the meeting. Other names mentioned as possibly willing to speak for the district were Don Fleishert Tom Ward of the Gargoyle, Werner Kuster, Mary Helen Cattell and Bill Dunaway. WEST END ASSN. No one was present at the meeting to give a presentation. GALENA ST. TRAMLINE Groen explained that the County wanted to put a tramline through the City and he thought it would be a good idea to let the County know how the HPC stands on having antique posts, etc. He would like to see a recommendation go to the County. Burns noted that they didn't have any real jurisdiction because of Ordinance 19 running out but Cole thought it a good i~ea to make their needs know while in the early stages of working out the budget. Groen saw no reason why they couldn't send a letter suggesting that they relate the plans to the historic core. Motion Frost moved to write a letter to the County Co~r~issioners directing them to consider the possible eventual historic designation of the ~owntown area and to relate the planning for the trams system to that possibility. Michaels seconded. All in favor, motion carried. DESIGNS FOR ANRAPOY/WHEELER Groen said that originally they had been planning on restoring the inside of the building including the original entrance but now with the possibility of a $500,000 grant for redoing the interior, they had decided to go ahead with having designs done for restoration of the exterior. Michaels questioned where the grant was coming from and Groen noted that the State was giving it to the City for the Centennial. Groen said that there was about $6,000 for the Anrapoy entrance not including the stairway but Cole thought they should hold off until they know how the $500,000 was going to be spent. Groen said that Mahoney assured him there were funds for redoing the south side in addition to the $1,000 for plans and that they should concentrate on getting some plans drawn up. Motion Michaels moved that they request the City Manager to authorize the beginning of design development for the Anrapoy entrance. Frost seconded. All in favor, motion carried. -1- Design, cont'd DIMNESS OF ANTIQUE LIGHTS ENFORCEMENT OF CONDITIONS HPC minutes 12-6-74 Cole asked if they had any particular architect in mind for the project and Groen thought that Mahoney should take care of that. Frost thought they should ask for bids but Cole said that with professional services, bids were not given. He said he assumed the architects picked before were chosen on the basis of background in the historic area. Cole also noted that he had gone to the Wheeler and thought it was going to be difficult to move the stairway since sewer lines would be in the way but thought it a good idea to have the outside plans drawn. Members asked that a memo be sent to the City Manager noting that there had been complaints about the antique lights not putting out sufficient light onto the street. Groen thought that they should send a letter to Mr. Sylvestri of the Solarium asking what his schedule was for redoing the mirrored glass in his restaurant since that was a conditon for approval from the HPC. The Chairman also noted that in the case of Deanna Brinkman, she had~still not complied with their condition of painting the aluminum and that Clayton had said that he would not give her a certificate of occupancy until she had complied. Burns also mentioned that nothing had been done about the little yellow house on Hopkins St either. Michaels suggested that the Building Department use their power to get these people to comply and Burns noted that Councilman Behrendt had brought up the problem of enforcement to Council since he didn't think they should pass the housing code unless there was going to be enforcement. Groen asked the members how they wanted to handle this problem - should they direct Clayton to follow up on these three situations? Burns said that in Sylvestri's case, there is nothing written in the code that says he can't have mirrored glass but Michaels reminded him that Sylvestri had made a commitment when he came before them and told them his plans for a cooler. Michaels said that if they closed his doors, they would probably see action fast. Cole thought a letter in order rather than such action but Groen explained that Michaels meant that Clayton has the clout to make these people comply. Groen thought that they should speak to him on an informal basis so Cole asked him to join the meeting. Bob Marsh arrives. Groen explained the situation to the Building Inspector and Meyring said that when there are so many rules and regulations that he has to enforce, he has too much to do without all the separate conditions of the Committee. Groen reminded him that the City Attorney had said that the Building Department is the enforcement arm of the HPC and Meyring thought that some mech- anism should be set up. Cole suggested a letter being sent to him with the conditions and Burns suggested using a stamp on the final building plans with their approval on it before a building permit is issued. Groen noted that it was now too cold to paint on Ms. Brinkman's building but thought that they could put a stipulation on the certificate of occupancy. Michaels didn't think thatthe C.O. meant much since the building was already occupied and noted that when he remodeled his restaurant, he couldn't open his doors until he had one. Meyring said that they usually withheld the electric meter. Burns thought that they should be able to simply state on the C.O. that by the.15th of May the aluminum must be painted. Marsh asked Meyring what the standard procedure was for building permits on issuance and what happens to someone who instead of building a 2 bedroom - $30,000 addition, as stated on the permit, builds a 4 bedroom - $90,000 addition? Marsh said that he knew this was an actual happending on 4th and Hallam. Meyring said that it was illegal and that sometimes people think that a building permit is good for whatever additions they want to make. -2- RECORD OF PROCEEDINGS 100 Leaves Regular Meeting Historic Preservation Committee December 6, 1974 WEST END OWNERS ASSOCIATION MEETING TIME ENFORCEMENT, cont ' d Motion Since Marsh, also a member of the West End Association, was now present at the meeting, Groen asked him if he was planning on giving a presentation since no one had showed earlier. Marsh was willing to give the presentation but the Secretary told him that Ramona Markalunas, another member of the Association, had thought it best to wait until after Christmas. He also mentioned that he had been told by the City Attorney that he had to work out an overlay for the West End. Burns asked Marsh if they had any documentation of historic buildings in the West End and Marsh assured him that Mrs. Markalunas had that material. Groen also thought that they should have a map with ~the boundarie~ and Burns suggested working out a legal description also. Marsh noted that they were going to have to work out whether to have any criteria or not, also. Groen asked members when they wanted to have the next meeting and it was determined that they should have a meeting the 20th since Council was going to have the public hearing on historic core area on the 23rd. Michaels wanted to bring up the problem of enforcement again because he felt that if Council believes in the HPC and establish- ment of the historic core, then members shouldn't have to waste time approving or disapproving unless there is some follow up to the conditions. Secretary noted to the members that Council- man Behrendt was asking all Commissions who are concerned over enforcement to write a letter to Council expressing their feelings. Groen thought this would be an effective way of helping Behrendt gain votes on the problem and also expressing their concern. Burns felt that they had been lax, also, and thought that they should institute a system for giving the stamp of approval only on final plans submitted to the Building Department. Michaels said that there was something wrong if the conditions couldn't be enforced by the Building Inspector and his staff. Groen thought that he should get together with Behrendt and make up a letter. Frost commented that she had talked with former Chief Ritchey who had noted the reason why the building code was so hard to enforce was because an owner may have as many "guests" as he wishes. Frost moved that they write a letter to Clayton Meyring regarding the yellow house on Hopkins and the Mill St. Station to make sure that they conform with the conditions of the HPC. Groen thought that there should be written notice reminding him of the discussion today. In that communication with Clayton, they should remind him that they want the tenant, Mr. Woodward, posted notice to get in touch with the HPC or the Building Dept. Marsh suggested that a letter be sent to the owner of the house. Groen agreed that Clayton should contact both tenant and owner of the house, check into the possiblity of making the painting of the aluminum strips and removal of reflective coating conditional on the Certificate of Occupancy per their discussion with Clayton this day.
