Main- vested rights DATE: November 13, 1996 SUMMARY: Once final approval is granted for a development proposal, an applicant automatically has 18 months of "vested rights." Vested rights guarantees the ability to undertake and complete the development and use of a property under the terms and conditions of a site specific development plan, with protection from regulatory changes which may occur after development approval. An aPPIicant can request, through a public hearing, vested rights which last for 3 years. At this time Joseph and Susan Krabacher request vested rights for the site specific development approval for 706 W. Main, as finally approved on August 28, 1996. No code changes which would impact this project are contemplated, therefore staff finds no reason to deny the request for vested rights. RECOMMENDATION: Staff recommends HPC approve Resolution # , Series of 1996 (attached), granting vested property rights for three years, starting from the date of approval of the site specific development plan for 706 W. Cooper Avenue, Unit E- Extension of conceptual approval DATE: November 13, 1996 SUMMARY: This project received conceptual development approval on November 9, 1994. Section 26.72.010 (F)(3)(c) provides that an application for final development review shall be filed within one year of the date of approval of a conceptual development plan. Unless HPC grants an extension, failure to file the final development application shall make the approval null and void. At this time the applicants, Bob Langley and Neil Ross, request extension of conceptual approval for one year, until November 9, 1997. The applicants' intent is to pursue final development approval this spring. Units A-D have received final approval, and two of the units have been built. RECOMMENDATION: Staff recommends conceptual development approval for 939 E. Cooper Avenue, Unit D, be extended until November 9, 1997. RECOMMENDED MOTION: "1 move to extend conceptual approval for 939 E. Cooper Avenue, Unit'#until November 9, 199*."
