Main Street, setback variance, PH DATE: October 22, 1997 SUMMARY: During a remodel of the existing structure, which included converting the building from residential to commercial use, a small enclosure for utility meters was built on the west side of the building. This enclosure was not part o the HPC approval and encroaches into the required sideyard setback. The applicant now requests approval for a sideyard setback variance. The property is a designated landmark and is located within the Main Street Historic District. APPLICANT: John Villari, owner. LOCATION: 633 W. Main Street. SECTION 26.72.010(D), REVIEW STANDARDS FOR ALL DEVELOPMENT INVOLVING HISTORIC LANDMARKS: This request must meet the four (4) standards stipulated in Section 26.72.010(D) ofthe Aspen Land Use Code in order for HPC to grant approval; an analysis ofthe proposal with regard to these four applicable standards follows. 1. Standard: The proposed development is compatible in general design, massing and volume, scale and site plan with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in a "H," Historic Overlay District or is adjacent to an Historic Landmark For Historic Landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot or exceed the allowed floor area by up to five hundred (500) square feet or the allowed site covered by up to five (5) percent, HPC may grant such variances ajter making a finding that such variation is more compatible in character with the historic landmark and the neighborhood, than would be development in accord with dimensional requirements. In no event shall variations pursuant to this section exceed those variations allowed under the Cottage Infill Program for detached accessory dwelling units, pursuant to Section 26.40.090(13)(2). 1 Response: The new utility cabinet is attached to a rear, non-historic addition to the house. It is minimal in size and uses similar materials as the historic house. The property is on a corner, so no neighbor is directly impacted by the setback variance. The variance allows for the utilities to be screened from view. Staff recommends that all wood siding and trim on the cabinet be the same color as the body of the house, so that the cabinet does not in any way stand out. 2. Standard: The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposedfor development. Response: The utility enclosure does not affect the historic character ofthe area. 3. Standard: The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or adjacent parcels. Response: The structure has been preserved and adaptively re-used with minimal alteratioils to it. 4. Standard: The proposed development enhances or does not diminish or detract from the architectural character and integrity of a designated historic structure or part thereof. Response: No architecturally significant portions ofthe building have been affected. ALTERNATIVES: The HPC may consider the staff recommendation (below), as well as any of the following alternatives: 1) Grant approval to the application as submitted; 2) Grant approval to the application with conditions, 3) Table action to a date certain in order to allow the applicant further time for restudy (specific recommendations should be offered); or, 4) Deny approval as submitted, finding that the application does not meet the Development Review Standards. RECOMMENDATION: Staff recommends the application for a setback variance be approved, with the condition that all siding and trim on the cabinet be painted the same color as the body of the house.
