HomeMy WebLinkAboutresolution.council.075-00 RESOLUTION NO. 75 (Series of 2000) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, SUBMITTING TO THE ELECTORATE OF THE CITY OF ASPEN A CERTAIN QUESTION AT THE AUGUST 8, 2000, SPECIAL MUNICIPAL ELECTION, AND SETTING SUCH BALLOT TITLE AND QUESTION. WHEREAS, the City Council desires to refer a certmn question to the electorate of the City of Aspen regarding a certain proposed pre-annexation agreement between the City of Aspen and the Zoline Family for the joint development of an affordable housing project on a portion of the city-owned Burlingame Ranch and a portion of the Zoline Ranch owned by the Zoline family; and WHEREAS, the City Council is authorized pursuant to Section 5.7 of the Aspen City Charter to, on its own motion, submit questions to a vote of the electorate. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO. THAT: Section 1. The following question, authorizing the City of Aspen to enter into that~certain proposed pre-annexatton agreement with the Zoline Family, shall be placed on the ballot at the City's special municipal election to be held on August 8: 2000: CITY OF ASPEN BALLOT QUESTION - BURLINGAME VILLAGE AFFORDABLE HOUSING PROJECT PRE-ANNEXATION AGREEMENT Shall the City Council enter into a pre-annexation agreement with the Zoline family to jointly develop an affordable housing project through the City's land use process on a portion of the city owned Burlingame Ranch property and a portion of the Zoline Ranch? The key provisions of the proposed pre-annexation agreement are as follows: * At least 20 acres of the Zoline Ranch will be conveyed to the City; * The City will construct up to 225 affordable housing units on the land conveyed to the City and upon an adjacent 5 acre portion of the city- owned Burlingame Ranch; * Approximately 170 acres of the 219 acre project shall have a perpetual conservation easement placed upon it; * The Zoline family will process a land use application to develop up to 12 new free market units, maintain the existing 4 ranch compound residences, and develop a cabin on the fathering parcel of the Zoline Ranch; * The allowable floor areas for the free market units shall be limited to 7,500 sq. ft. each with an opportunity to increase the size up to 10,000 sq. fi. with the purchase of a Pitkin County Transferable Development Right (TDR); * Each free market unit shall construct an accessory dwelling unit unless the owner purchases a Pitkin County Transferable Development Right; * If Transferable Development Rights are not available, a cash payment equal to the value of a TDR will be permitted to be made to the Housing Authority; * The entire Zoline Ranch shall be annexed into the boundaries of the City of Aspen; * The affordable housing and free market component lots shall be re- zoned to the City of Aspen's Affordable Housing/Planned Unit Development (AH/PUD) zoning district. The full text of the proposed pre-annexation agreement is available for public inspection in the City Clerk's Office during regular business office hours.
