PLANNING & ZONING
OCTOBER 18. 1988
Chairman welton Anderson called meeting to order at 4:30 pm.
Answering roll call were Michael Herron, Bruce Kerr, Mari
peyton, Roger Hunt, Jasmine Tygre and welton Anderson. Graeme
Means and Jim Colombo were excused.
COMMISSIONER'S COMMENTS
Roger Hunt: I happened to talk to 2 people--one in the Williams
Add i tion and one in Smuggler. It was a very interesting point
that they made. That is that they had signed a petition for
annexation and they are about to remove their names from it until
this Hadid thing is resolved because they don't want to annex to
a City that is going to be put down the tubes as far as the
lawsuit is concerned.
welton: I have been talking to Glenn on several different
occasions concerning the 1010 ute. Glenn called me a few weeks
ago and asked if I remembered the discussion in the approvals
about the houses that were to be built on the ridge. I said I
remember seeing some drawings of these cute little I-story
houses perched on the ridge, and that our condition for approval
was that the houses not project any more than I-story above the
ridge.
Now that the trees are losing their leaves, you can see from the
Aspen Club on the pathway that the houses in fact do only stick
up only one story above the ridge but it took the ridge out for 2
stories below. So it is now 3 story houses.
Do you all remember the discussion about I-story projection above
the ridge?
Roger: I vaguely recall the drawing of I-story roof line above
the ridge.
Welton: Well, they have taken the ridge down. I talked to Skip
the other day and asked him what was the deal here. we approved
a I-story projecting above the ridge. He said nOh, we couldn I t
do that because the sites are so small we had to take the ridge
out".
I would like to find out what the rest of the Commission would
like to do about this. Would the Commission like to go take a
look at it?
Jasmine: One of the reasons I was impressed by the project on
paper was in the representation that the natural terrain would be
respected. I seem to remember almost exactly those specific
words. To me that was very important because we had seen other

Glenn: Their covenants say that.
wel ton: I thi nk it is time to tell the development community
that if you tell us one thing and you deliver something else, you
are going to have to tear it down and make it right.
It was then decided by the commissioners to meet at the parking
lot of the Aspen Club October 25 at 4: 30 in order to do an on
site inspection of the 1010 ute site. The meeting would then be
continued at City Hall.
Welton: I remember as part of that process we went to the Aspen
Club parking lot to look to see what it would look like over at
the ridge.
Glenn: At that point I was trying to tell you not to allow them
to even touch the ridge. I thought the ridge should be left
undisturbed and bring the buildings closer to the road. The final
grading plan clearly shows the ridge being there. But there
would be buildings in the ridge.
Roger: I don't think we approved anything to allow them to touch
the ridge. Did we see that final grading plan?
Glenn: The Council did. And you did get that. I made it really
clear that I was very unhappy with it and that Bill stirling was
unhappy with it and that it wasn't the way you remembered it at
all and so he knows that there is some concern.

ADOPTION OF ANNEXATION ELEMENT
PUBLIC HEARING
Welton opened the public hearing.
Glenn Horn and the Commission members went through the Annexation
Element, made corrections, additions and deletions.
Public Comment:
Phoebe Ryerson: I am shocked to find a difficulty in facing the
fact that there were 16,000 miners in the little old Aspen and

those miners managed to get along and they didn't wreck the tone
of Aspen. Is it not possible to face the fact that 2/3 of us in
the 13,000 residents of the county were 2/3 out of the voting.
All the issues that are coming up now were in the questionnaire
that somebody got going about 12 year sago. Even then the
putting together the County and the City was absolutely the
people's pleasure. It is simply astounding to 2/3 of us that we
can't be given the dignity of a vote.
Glenn: what we are finding out is that for many people the
annexation's decision is hinged on the Land Use decision. And
when we go into the neighborhoods and talk to them--Mountain
Valley is the perfect example--they are debating on whether or
not they actually want to be in the city based upon the Land Use
decisions.
Bruce Kerr: There is nothing to prohibit anybody from being
franchised if they want to get together with their neighbors and
petition. I think under state law that can happen now. There is
nothing to prohibit that from happening if they feel strongly
enough about the issue.
welton asked for further public comment. There was none and he
closed the public hearing.
MOTION
Roger: I move to adopt the Aspen Area Comprehensive Plan:
Annexation Element as amended this evening. And that this be
adopted by resolution to be signed by the Chairman.
Jasmine seconded the motion.
Glenn: I am going to work on the problem on page 4.3 about the
land and the Highway 82 corridor and try to come up with
something that Welton feels comfortable with and if he doesn't,
we will just come back and go over that.
Roger: And the other major one is addressing the base ski area.
All voted in favor of the motion.
HISTORIC DESIGNATION OF MAROLT/THOMAS HOOSE AND BARNS
PUBLIC HEARING
Cindy Houben: Made presentation as attached in records.
Welton opened the public hearing and asked for public comments.

Phoebe: I would like to have you know that somebody has turned
up that said he could build, at worth, because he likes Aspen and
has retired, at cost, 500 mixed anywhere units. I have talked to
Tom Baker and Jim Adamski. Jim is going down to talk to this man
and he says he can do it by the music festival next June.
It sounds incredible the way we stall around. It seems to me
that there is lots of money and also we are told by everybody at
these meetings that there is a lot available.
Margaret: If these are historically designated, does that
prejudice the future use?
Cindy: It is my understanding they are protected then under the
historic guidelines. It is not a National Historic Register
application at this point. It is a local with a local ordinance
which means that it would have a historic overlay which would
mean that we would have to any time any alterations to the
building occurred it would go through the HPC process.
Mari: But not use. It could still be used as a house.
Alan: In fact designating makes it easier because it opens up a
whole Growth Management exemption process and allows much more
varied uses to take place.
Wel ton asked for further public input. There was none and he
closed the public portion of the hearing.
MOTION
Michael: I move to approve the recommendation of the Planning
Office for historic landmark designation: Holden-Marolt Barns
site/Lixiviation Ruins and the Opal Marolt House.
Jasmine seconded the motion with all in favor.
DISPLACEMENT/AFFORDABLE HOOSING CODE AMENDMENTS
PUBLIC HEARING
Welton opened the public hearing.
Alan and the Commission members worked through the draft
resolution item by item, made suggestions, additions, corrections
and took public comments.
Welton continued the public hearing to 5:00pm, October 25, 1988.
Meeting was adjourned. Time was 6:45pm.
