Galena St. Aspen, CO 81611 RE: Bellis Stream Margin Review Dear Amy, The Aspen Consolidated Sanitation District currently has sufficient collection and treatment capacity to serve this project. The District will continue to work with the applicant's representatives throughout the application process to ensure that service to this property adheres to the District's Rules, Regulations, and Specifications which are on file at the District office. The letter referred to in the applicant's proposal was written when only a driveway was proposed on the ACSD easement and no longer applies with the current entrance, landscape and patio design. The proposed permanent structures that encroach into the easements will not be allowed. The applicant will be required to remove and replace at the applicant's expense any and all soft landscaping placed within the easement. Additional access easements will be required from the property owners to the west. New easements on standard District form must be granted the District for the main sanitary sewer line that runs along the west property line. An encroachment license will be required for any improvements made to the site that are placed in the District's easement. The sanitary sewer service lines that serve properties to the east which run along the northerly boundary of the property will need to be relocated at least 10 feet from any permanent structure. The Aspen Consolidated Sanitation District will have to review the relocation of the storm sewer and related facilities. The applicant will be required to mitigate any impacts to the District's facility due to the relocation at the applicant's expense. A tap permit must be completed at our office when detailed plans become available. Fees will be estimated at that time. Hopkins Avenue; and WHEREAS, Pursuant to Section 26.68.040 of the Aspen Municipal Code, Stream Margin (ESA) review may be approved by the Planning and Zoning Commission in conformance with the requirements of said Section; and WHEREAS, City Engineering, Parks Department, Aspen Consolidated Sanitation District, Fire Department and Community Development Department reviewed the proposal and recommended approval with conditions; and WHEREAS, the Planning and Zoning Commission reviewed the application at its regular meeting on June 3, 1997, at which the Commission approved by a 7-0 vote the Stream Margin review application with conditions. NOW, THEREFORE BE IT RESOLVED by the Commission: Section One: That the Stream Margin (ESA) review for 1008 E. Hopkins Avenue (Parcel No. 2737- 181-25-001) be approved subject to the following conditions: 1. A current Site Improvement/Topographic Survey certified by a registered land surveyor, licensed in Colorado showing the location of any utility easements, wetland and riparian vegetation areas, the Special Flood Hazard Area, and fishing and trail easements shall be submitted in accordance with Section 26.52.030(B)(5). 2. The building section drawing must be labeled "top of slope" and reference the topographic survey. The "top of slope" drawing must be signed and stamped by an engineer or surveyor licensed to practice in Colorado. The establishment of top of slope must be approved by the City Engineer. 3. A building envelope must be indicated on the site plan. Construction barricades must be installed along this envelope prior to issuance of any demolition, excavation or building permits. The barricades shall remain in place until the issuance of Certificates of Occupancy. 4. Building permit drawings must include a drainage mitigation plan or report signed and stamped by an engineer registered in the State of Colorado, in order to demonstrate that no drainage will be conveyed to the river bank. If the driveway across City property is approved, the agreement should include that the site development meet the requirements of runoff design standards of the Land Use Code at Sec. 26.88.040.C.4.f. 5. The applicant must obtain an encroachment license for the proposed driveway access. 6. The structure must be sprinkled for fire protection since the driveway access is less than 20 feet wide or meet the requirements of the Fire Marshall. 7. Pursuant to Section 26.68.040(B)(5), the applicant shall provided a plan addressing pollution or interference with the natural changes of the river, stream or other tributary, including erosion and/or sedimentation during construction. The applicant shall provide a plan to accommodate on-site drainage within the parcel to prevent entry into the river or onto its banks. The applicant shall provided a plan addressing any pool/hot tub drainage. 8. The applicant shall acquire approval from the appropriate utility companies for any proposed construction activity within utility easements prior to the issuance of any building permits. 9. A landscape plan pursuant to Section 26.68.040(B)(11) of the Code showing only approved native vegetation planting taking place below the top of slope or within fifteen (15) feet of the top-of-slope or the high waterline, whichever is most restrictive shall be submitted. No vegetation shall be manipulated outside the revised building envelope. The building envelope boundary shall be approved prior to issuance of any building permits. Revegetation is required for any soil disturbed on the site. A tree removal permit shall be required for the removal or relocation of trees as per Section 13.20.020 of the Code. 10. All exterior lighting shall be low and downcast with no light(s) directed toward the river or located within the no development setback or down the slope pursuant to Section 26.68.040(B)(12) 11. The applicant is strongly encouraged to submit a design for a storm sewer line and sewer outfall that accommodates historical drainage, and dedicate and record a storm sewer easement that allows the City to maintain and operate this storm sewer line, for review and approval by the Engineering Department. If owner does not dedicate this easement, owner shall include a note on the final plat indicating that the owner of the property is responsible for maintaining the historical drainage through the parcel. 12. Prior to issuance of a Building Permit, owner shall complete and record a Sidewalk, Curb, and Gutter Agreement. If agreement is reached with the City to cross city land with a driveway, the agreement should include extending the sidewalk, curb and gutter across the frontage of the City property to connect with the sidewalk, curb and gutter at 1001 E. Hopkins. A drainage report will be required. 13. All material representations made by the applicant in the application and during public meetings with the Planning and Zoning Commission shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions. 14. All terms ofthe trail and fishing easements must be adhered to. 15. Any landscaping on the City owned property to the west of the subject site will be with the permission of the City Parks Department. APPROVED by the Commission at its regular meeting on June 3, 1997.
