The special Council meeting was called to order at 7:15 p.m. by Mayor Standley with
Councilmembers Behrendt, Breasted, DeGregorio, Markalunas, Pedersen, City Manager Mahoney
and City Attorney Stuller present.

The special meeting to consider the Molterer Sports awning was called at the request of
Councilman DeGregorio and he introduced the matter. He said the letter that the Council
received at the January 13th Council meeting uncovered some things that were not brought
out before. DeGregorio also said he liked the awning and did not think it was hurting
the Magic Pan's business. DeGregorio wanted to hear from tke Molterer Sports people again,
but they were not present.
Councilman Walls arrived.
Bob Rosener of the Magic Pan in Aspen had flown Chuck Rutter up from Denver. Rutter told
Council he had been involved with Kay Cheek about the awning a year and a half ago and eve~
discussion he had had with her, she had said the awning would not go across the sidewalk.
Bob Rosener told Council he had gone over the Magic Pan's books with City Attorney Stuller
and felt, in fact, that their business was being hurt by the awning obstructing the
Magic Pan's sign.
Councilman DeGregorio said he felt bad that Mrs. Cheek isn't here to give her side, perhap~
Andrel Molterer could shed some light on the problem. Molterer told Council he would be
willing to cut the awning back if they wanted him to.
City Attorney Stuller pointed out to Council that the next step in the whole proceedings
was to serve a Municipal Court summons on Molterer Sports for trespass, but she had held
up doing so to wait for the outcome of this special meeting.
Councilman DeGregorio made a motion to keep the awning where it is; he doesn't feel it
is hurting the Magic Pan's business. Seconded by Councilman Breasted. Councilmembers
DeGregorio and Breasted in favor. Councitmembers Behrendt, Markalunas, Pedersen, Walls
and Mayor Standley opposed. Motion NOT carried.

City Manager Mahoney asked Chick Collins to come to Council and discuss problems of
City Hall he is concerned with. Chick Collins is a structural engineer and represents
the City on these types of problems.
Chick Collins submitted to Council a cross section of City Hall. He told Council that
as a result of his own inspection, he had sent a letter to the City one and a half to
two years ago that no snow over 12 inches be allowed on the roof. The roof and third
floor are in extremely bad condition. The roof truss system with lifters does not meet
standard requirements. The third floor has no~ been operative for many years because
it can sustain only minimum loads.
Chick Collins presented three schemes to fix up City Hall to the Council. The first
was to rebuild the entire roof. There is little that is very good up there and the
roof also needs to be rebuilt because it leaks inside City Hall and causes general
deterioration. A new roof and new columns would be introduced and founded on new
footings. This scheme represents the minimum amount of action that could be taken.
Scheme number 2 brings in framing that would go to the columns so that the third floor
could be used. The square footage of the third floor is about 4,700 square feet. The
first and second floors have about 5,750 square, feet.
The third scheme would include underpining the outside columns and would go down to the
basement and would gain an estimated 5,750 square feet.
The cost estimates of the three schemes is:
a) Scheme 9 1 $51,200 for the roof
4,800 for the columns

This wo~ld give no utilization of the third floor.

City Manager Mahoney pointed out to Council that we don't get anything for scheme
number 1 except the roof and we have to buy a new roof because at one point last week
there was 14 inches of snow on the roof. If the City spends another $15,000, we buy
4,700 square feet of usable space.
Councilman Breasted said he would go for that scheme (number 2) with the columns
extended deep enough so that it would make the final basement scheme feasible some-
time in the future. Councilman Behrendt pointed out that scheme number 2 would cost
closer to $100,000 after the finishing was done. He requested some finished costs
schedules to be brought back for the shopping list in February.
Councilwoman Markalunas said that if City Hall were nominated for the National Register,
the City had the possibility of applying for Federal funds in the future. Perhaps
the City could do the minimum amount of work now and wait to see if any Federal funding
were possible.
The Council decided to have City Manager Mahoney get estimates of what scheme number
2 wo~ld cost finished and resubmit this to Council for their shopping list.
The Council went into executive session. Councilman Walls left during the executive
session. At 9:45 p.m. the Council reconvened into the special meeting.
Electricity UTILITIES

Larry Simmons, Regional Economist, made a recommendation to the Council not to do
anything with the electricity rates until April 15, 1975. He also told Council that
he didn't know where we stood with the Colorado Ute transmission line. The county had
not accepted their environmental impact statement.
Post POST OFFICE

Councilwoman Markalunas moved to have direct negotiations with the U.S. Post Office
for the sale of the railroad yards premised upon home delivery mail service be provided
to the City of Aspen, and that negotiations with Aspen One will continue for Tract A.
Seconded by Councilman Breasted.
Councilwoman Pedersen asked if the post office was willing to submit to architectural
controls. Mayor Standley answered that they had said they would not. Mayor Standley
said the Council should have in mind what they want on the land and what will be
compatible with whatever the City plans for that land.
Councilman DeGregorio called the qusstion. All in favor, motion carried.

Councilwoman Pedersen; all in favor, motion carried.
