RECORD OF PROCEEDINGS
PLANNING & ZONING COMMISSION
OCTOBER 2. 1990
Chairman Welton Anderson called meeting to order at 4:30pm.
Answering roll call were Sara Garton, Graeme Means, Bruce Kerr,
Mari Peyton, Roger Hunt, Jasmine Tygre and Welton Anderson.
Richard Compton was excused.
COMMISSIONER'S COMMENTS
Graeme: In thinking about the access to the Meadows I was
wondering if there was a solution that would get everybody
equally upset and that would be to run a 1-way loop where perhaps
they would put the new road in by the new houses there but have
that one-way going in which would make 7th Street not as impacted
and then going out of the Meadows you put 8th Street. Does that
make any sense?
Roger: In other words join 7th and 8th as I see Bill Dunaway
finally got on an editorial?
Graeme: That was a little different.
Sara: I would like to support that too. I walked that the other
day and I thought it would be a compromise for everyone.
Roger: Well, I am definitely in favor of joining 8th Street to
7th Street if we still have to have a 7th Street as opposed to
cUI-de-sacing 8th Street. That makes no sense to me to cul-de-
sac 8th Street. Why not join it in and maybe have the
predominant street 7th Street going into the Meadows along the
east side of the tree line as it is shown now. But having 8th
Street at least going somewhere and that is to an intersection on
Meadows Road by that time.
Welton: I think that coming up with solutions to the Meadows
access should probably be discussed during the Meadows meeting
and not during Commissioner's comments. It is a good suggestion.
Amy: It was discussed. The problem most people have is we have
2 pavements right alongside each other.
Graeme: Well, they could join at that point.
Amy: Pavement and make one or the other a trail.
Roger: See where they are showing a cul-de-sac now it is right
next literally to Meadows Road where they are showing the cul-de-
sac and my point is that cul-de-sac is useless. Why not run it
and terminate it at Meadows Road?

Mari: I am sure the objections will be that the homeowners on
7th don't want to have to go all the way around this loop.
Graeme: It would only have to be 1-way from where it starts in
the grove of trees along by the new houses. The rest of 7th
street could all be 2-way. Then just have that on1-way and then
this 1-way coming out.
Welton asked if there were any other Commissioner comments.
There were none.
Welton: I would like to take this opportunity to announce that I
am going to step down from Planning & Zoning commission as of
November 15th ~ when we get the Meadows done. And that could be
years! But the Meadows was the first item that I was involved
with 15 years ago when I got on P&Z and I don't want to leave it
undone.

Amy: I have heard from various people in the community that it
may be a good idea when you hear the Meadows to only hear the

hearing the pedestrian walkway plan to continue that and only do
the Meadows.
Welton: I agree that that is appropriate.
Bruce: I want to notify the clerk that I will be here on the 9th
after all but probably not the 16th. I would very much like to
meet on the 9th on the Meadows and try to get that resolved if we
possibly can. Then perhaps the 16th only be a formality. That
would be great.
Commission members all agreed to devote entire 9th meeting to the
Meadows.
Amy: We will schedule the pedestrian walkway plan for Oct 23rd.

HALLAM LAKE PIPELINE STREAM MARGIN REVIEW

The Parks Dept wants an amendment to #1. Any trees that are
removed must receive the standard tree removal permit as required
by the City and replacement shall be 1 to 1 with 2 and 1/2 inch
caliper trees.
Roger: I notice that the pipeline is going under the Rio Grande
ROW which is planned to be reactivated. What is going to be the
depth of the pipeline or is it going to be re-enforced
sufficiently that it will be all right to re-establish train
service over that.
Jim Gibbard, Eng. Dept: It is going to be very deep because we
have to go under the sanitation main trunkline. All that is
required is there be a 5ft cover along the entire length of the
project. But because we have to go under that trunkline I
anticipate we are going to be lot deeper than 5ft in that area.
Roger: I don't want the pipeline crossing the Rio Grande to do
anything to interfere with re-establishing rail service there.
So it should either be down deep enough or re-enforced.
Welton: Why don't we add condition #2 that the pipe is a
sufficient strength and sufficient depth so as to not create any
difficulties for the re-establishment of rail service.
Kim: Condition #2 would be Prior to excavation permit issue a
barrier shall be installed across the Art museum parcel defining

the area of vehicular movement and material storage during
construction because it is a sensitive site. We will establish
one of those nylon string fences or snow fences to keep the dirt
storage and front end loaders from traversing the entire site.
Although the contractor has requested that the central area where
it is wider in that Art Park area the corridor shall also be
wider because they will need that additional room.
Bruce: Do we know--are there any guarantees that by installing
this pipeline we will solve the problem that Hallam has. Is that
a foregone conclusion?
Gibbard: No. There are no guarantees.
Bruce: So we could be building the pipeline and we still could
have problems at Hallam Lake?
Gibbard: That is a possibility.
Roger: Have you seen the flow of water from that pipeline?
Bruce: No.
Roger: It is pretty substantial. And theoretically if putting
in the parking garage diverted that water from Hallam Lake and
you now move that diversion back to Hallam Lake, Hallam Lake will
get whatever it was supposed to get is the way I look at it.
Gibbard: We are looking at 800 gallons per minute.
MOTION
Roger: I move to approve the stream Margin Review for the Hallam
Lake pipeline with condition #1 being changed to indicate 2 and
1/2 inch caliper trees. condition #2 that the pipe will be of
sufficient strength or depth not to interfere with re-
establishment of rail service on the Rio Grande ROW. Condition
#3 Prior to construct a snow fence will be erected across the Art
Museum property to define the construction area and to keep
construction vehicles from getting out of the area of
construction.

HALLAM ESA MAP / TEXT AMENDMENT

Joe Wells: I do not understand what the definition of top of
slope is as per the memo.
Kim: Top of slope means the point or line of points determined
by the intersection of, and this is the new part, 230ft long
lines, one being the level of the existing grade above the slope
and the other being the angle of the existing slope.

MOTION
Welton: Would somebody like to make a motion approving the text
of the ESA and the map overlay with the inclusion of the text
concerning further description of top of slope.
Jasmine: I will so move.
Sara seconded the motion.
Roger: Given all I see here as far as identifying the top of
slope I see it as everything here is to be adverse of ACES. When
I brought up the question of the pole along the ground and
someone saying "Well it is only 4ft". That only happens to be
about 28 to 30% of the 15ft and 30% is a lot. I would really and
now especially when that 45 degree angle is moved out to this
fictitious point which to me is very advantageous to the
developer. It is very disadvantageous to ACES because it all of
a sudden projects something out more in an effect a viewplain as
someone down in the ACES area is looking up here there is even
more of an opportunity for the building not to be screened by the
slope.
I feel that this ends up being very adverse to ACES. My tendency
is to a protest no vote but that doesn't mean I don't want to
protect ACES in this.
Welton: ACES was substantially responsible for developing this
as a concept.
In my opinion if ACES has developed this and is happy with it
then I am more than happy to defer to them. I think that their
position is probably that this approach will forever make it more
difficult or impossible to do anything like perhaps the most
damaging development that has happened along the edge. But it

won't eliminate impacts altogether. It will just make the most
horrendous examples not possible in the future.
Kim: This setback area is 15ft and the slope allows for that
much more area to be vegetatively screened. Whereas before going
right to the slope or even starting to go down the slope is
lessening any potential for screening.
Everyone then voted in favor of the motion.
ZONING DESIGNATION FOR HALLAM LAKE PARK SPA
Welton: When land is annexed into the City it is rezoned. The
Planning Office is recommending that the zoning for ACES be Park
SPA. Are there any questions regarding this SPA park?
Roger: It is my suggestion that we take the necessary steps to
add Nature Preserve under the purpose section of the Park code.
MOTION
Roger: I move to find that the ACES Nature Preserve does fall
within our concept of the purpose of p-park and recommend that
the property be zoned Park SPA on annexation to the city.
Jasmine seconded the motion.
Graeme: This parking thing is in here. Sooner or later we will
have to come to grips with the parking on this parcel. Is there
anything we can do at this point concerning that?
