Answering roll call were David Brown, Tim Mooney, Sara Garton, Roger Hunt and Bruce Kerr. Jasmine Tygre was excused. COMMISSIONER COMMENTS Roger: I met today with Bill Efting concerning the condition of the 100 year old Cottonwoods generally in the City and why don't we have a 20 year program of replacing them slowly instead of in 20 years not having any Cottonwoods. He said it is a fantastic idea and he set up a meeting with George Robinson of Parks Dept and they are going to try to get a tree expert and talk over this thing and find out what sort of a program would work for the City. Sara: I suggest you call Vail. They have a terrific citizen tree planting program. STAFF COMMENTS There were none. PUBLIC COMMENTS There were none. EAST COOPER AFFORDABLE HOUSING PROJECT SPECIAL REVIEW Kim made presentation as attached in record. Bruce: I have a question for staff. Is any kind of public notice required on this special review? Kim: No. It is not. Special review does not require publ ic notice. What we are going to do is There is a PUD overlay on this parcel and PUD documents are being processed now for recordation. So what we are going to do is process an insubstantial PUD amendment which is something that the Planning staff does and it is usually a 2 page memo whereby the Planning Director signs off on staff findings of your particular motion or action. That will also be in the record to address the change to approvals that were granted by Council. Roger: Asked about the 30 foot height. '.- / Kim: Height according to the definition in the code is measured to the mid point of the roof. Sara: In the presentation by the applicant we brought up the height and he mentioned 30 feet at that time. They were more concerned about the viewplain of the free market homes and the individual homes. I don't think we are going to surprise the Riverside homeowners. How many resident occupied lots were presented as part of the proposal to this? ? : There townhomes. is only one lot. There are 3 resident occupied And then the rest are within category III form. Sara: There are 3 resident occupied townhomes? I was told by a Riverside homeowner that the people that have earnest money on those homes and gone ahead and flipped them already--resold them. ?: That is not right. In fact there is none of the 3 homes that we have signed the contracts on. And there is no earnest money. Kim: The applicant agreed to be regulated by whatever regulations were in place at the time prior to the actual sales of the first units. ? : The other thing we agreed to do as a favor to the Housing Authority is document the sales on not only the entire project but specifically the RO units because they were as curious as we were as to what this thing was going to shape out to be. They wanted to have access to that information and we are going to provide that to them. MOTION Roger: I move to approve the Special Review for a height increase from 25 to 30 feet on Lot 6 of the East Cooper Affordable Housing Subdivision as allowed by dimensional requirements under the AH or Affordable Housing Zone District pursuant to the criteria in Section 24-7-404 of the Aspen Municipal Code.
