PLANNING , ZONING COMMISSION
AUGUST 17. 1993
Chairman Bruce Kerr called meeting to order at 4:30 P.M.
Answering roll call were Jake vickery, Tim Mooney, David Brown,
Sara Garton, Roger Hunt, Jasmine Tygre and Bruce Kerr.
COMMISSIONER COMMENTS
Roger: I have some problems with taking parking off the north part
of Main Street to accommodate this bus lane. I have talked with
people like Jack Reid and Randy Ready. One of my major problems
with losing any parking on the north side of Main Street are with
things like doctor's offices and conditional use approvals. I
would like to get a little feedback from the rest of P&Z. Do you
think this is a problem? I want to give our point of view on this
at the meetings.
Jasmine: I am with you, Roger.
Bruce: I would say probably all of us agree to taking the parking
out would be a problem. The question is whether we buy into what
your alternative solution is. If you want to convey to the various
groups that the P&Z has a problem with elimination of the Main
Street parking that is a safe assumption.

Leslie: Are you talking about just the north side of Main Street?
Roger: Yes. Just the north side. And they were going to re-
configure the aligning of Main Street.
Sara: For an HOV lane.
Roger: But it was just basically going to be a transit lane using
the present parking lane.
Sara: The only thing--parking on Main Street is a problem for
traffic. If someone decides they are going to parallel park and
they stop, everything is backed up. So I believe there should be
discussion. People park in front of the Main Street Bakery,
Explore--everything is jammed up for that 4 lane all the way back,
Roger. And for dropping skiers on and off the bus stops there is
a problem when there is parking there.
Roger: I am all in favor of getting the buses to the head of the
line but we can do it within the existing lanes quite easily.

Francis: Roger had asked about the Ritz Ice Rink regarding the
elevations. As near as I can tell (at this point the outside

traffic noise is all that is audible. Henceforth I will indicate

street elevations were given so I compared those things--
Roger: The plan that we saw had a treatment along the south side
of the rink where they had ramps going down and I recall something
like a 3 or 4 foot elevation difference between the sidewalk and
the skating rink itself.
Francis: It is possible that it may have come out differently at
the final approval. I know they made some changes. But as far as
what I know all the permits and everything were issued, all the
elevations were as approved on the final plats.
Diane: It is right on line.
Bruce: I think what Roger was getting at was the elimination of
the potential attractive nuisance. In effect having activity at
the ice rink draw people across from Ruby Park mid-block and be J-
walking instead of crossing at the corner. And that was the object
of having it down.
Diane: The rink is going to be down.

Roger: Not 3 or 4 feet. And that is the way it was presented to us.
Sara: I remember saying "Oh
Center". And Perry said "No.
Street you will look down but
it is going to be like Rockefeller
Not from Durant Street. From Dean
not from Durant".
Sara: What is going on with our kayak course?
Leslie: We have been issued our 404 program. In the Spring when
we had all of our high water, the Corp told us we had to block it
off this year to protect from the severe high water because our
vegetation hadn' t quite taken ahold. So we had to protect our
vegetation for another year and we may have to protect it for a
couple of years to make sure that the high water doesn't undercut
the bank and the willows we planted. We have lost some of our
vegetation but we are going to replace it.

CONDOMINIUMIZATION TEXT AMENDMENTS TO CODE
Bruce opened the public hearing.

Roger: In the definitions do we have long term defined?
Francis: No.
Roger: Our concept for long term is that it is rented for more
than a 6 month period.
Bruce: Any time you add language to the code and that language is
not defined then you create problems.
Francis: You are right. Whether we want to actually describe that
and say "Long term means 6 month leases. As it is listed in the
code now it is a 6 month minimum lease with 2 shorter occupancies
per year.

Bruce: Put it under the definition section and say "Long term as
used in description residential zone districts".
Sara: Because this is a statute that has come down from State and
they declare that it is not retroactive can it be challenged in the
courts locally by former condominium' deed restriction that say "We
don't think retroactive--
Francis: They could Challenge it but I would say no I really don't
think they could do that because it is a State legislation and we
don't have much to do with it except to say we don't want to remove
it and the State doesn't require us to.
Roger: I came to the meeting predisposed to alternative B. But
getting the definition of "long term" in there that supports our
case if someone wants to come in later and try to get that
restriction off. So I support alternative A.
Francis: This regulation grew out of a concern that you have an
apartment building that was rented low moderate income housing.
And what happens with condominiumization is all of a sudden the
owners is selling them off and selling at a higher price and that
tends to be second homeowners. And they do that to some extent.
I also feel that rents are going to go up regardless of whether it
is owned by one person or as a condo. Rents are going to be raised
to keep pace with the economy. If you don't keep pace you are
going to be displaced anyhow. So it is a little different than a

discussion about accessory units being rented to friends and guests
and relatives.
My own thought is that the market is displacing people more than
the condominiumization itself is. I really think it was in a way
a misguided approach to resident housing.
Bruce: We have had discussions all through this regarding bandit
units and all that sort of thing. How we deal with it and not
unfairly impinge on property rights of the main house owner would
be to try to figure out a way to get these things occupied and
monitored.
Diane: As we go through the budget process with council I am going
to request that we start charging for the review of ADUs ?
exempt from planning application with the idea being we--are
providing some sort of housing in the community. What we have
found is that out of all of these ADUs none of them has registered
with the Housing Authority. So we are going to revising that whole
program in the next couple of months.
Bruce asked for public comments.

Roger: I move to direct the Planning Office to elect alternative
A in resolution form to be signed by the Chairman of P&Z with the
addition of the definition of long term.

David: I would like to encourage the elimination of all signage.
I agree with Alice that all of the users of the building know where
they are going. This oversignage is detracting from the
characteristics that are desirable in the west end. Also loading
and unloading areas.
since the ELC has occupied as far as I am concerned there had to
be a specific radon test that talking to a couple of radon
consultants about that project they felt that an adult use would
be acceptable. The previous radon levels were fairly low and
adults were not susceptible to the impact of radon. Children on
a single pain glass windows are __?__ there is enough air leakage
to allow radon to escape to eliminate high concentrate.
MOTION
David: I move to approve the Early Learning Center parking plan
with conditions #l--The Early Learning Center identify a date for
which a property manager will be on board and notify the neighbors
and the Planning Department of the selection.

#2--The ELC shall work with Chuck Roth of the Engineering Dept to
increase the width for pedestrians on Bleeker street between the
fence and head-in parking giving primary consideration to the use
of curb stones--not moving the fence.

#3--The ELC shall update the Commission as to their compliance with
other conditions of approval to include what tenants have leased
space in the building to date.
I would like to bring in the approval the references to signage
which is item #2 on the first page.
In #2--don't move the fence. Don't move the curb. Just use curb
stones or some other low impact solution such as diagonal parking
and striping.
Tim: As part of the residential permit parking process and as part
of the ongoing reformation of the use of the building I think that
consideration should be given to using some of the playground as
parking. And consolidating the uses of the playground so that they
are adjacent to the Waldorf recess or the ELC lower age groups as
they recess.
I am thinking mainly the west end. And maybe it could be a revenue
base. Sell parking permits for residents in the area to use that
or use it for staff instead of having designated a parking space
on the street. Why not reconfigure the use of the playground and
now that it is not going to have the volume of kids in the school

you have for what you need it for.
Tim seconded the motion.
Sara: I disagree with David's motion about the signage because I
think the loading and unloading area is very important to sign.
I know 8 people that park day long in that area. They would rather
do that than pay the parking garage. It is a big problem around
there and I think you need to designate where the entrance is.
Roger: I would like to see some sort of sign
indicating that this is where that is located.

Roger: Would you consider amending your motion to allow the
addition of mumble
David: I would be reluctant to require that of the school. I
think it is a good idea and I think a temporary sign for loading
and unloading is a good idea. But I would like to put the burden
of the cost of that on ____mumble___it is a temporary use
Temporary in the sense they are leasing from the school system.
Roger: Could it be phrased in the form of a recommendational
requirement?
David: Absolutely. That is acceptable. I also amend my motion
to recommend that the ELC and Waldorf School sign their entrance.
Leslie: So that would be your 5th condition of approval that P&Z
recommend the ELC and Waldorf School sign their entrance.
David: Yes.
Tim accepted this recommendation to his second of the motion.
All voted in favor of the motion.
