HomeMy WebLinkAboutminutes.council.19600404 Aspen, Colorado Re~mlar meeting of. the Aspen City Council April 4, 1960 Before the meeting.was formally opened, Tom Sardy informed Council that the Pitkin County Hospital 'officials and the County Commissioners would meet Thursday to write up final plans for the Hospital. He.drew attention to the waterline now under the Hospital and requested a letter of assurance that the line would .be moved. Discussion followed as to easement and cost of moving line being paid by County. Clerk was instructed to send a letter to Mr. Sardy stating that so long as Hospital Council is assured that the water line will have a right of way, the line will be removed frc~ under Water line the Hospital building. Matter of actual rem~val to receive further consideration. Mr. Sardy told Council that the dog problem is receiving consideration by the County. He will come in aud tell the Council the facts ~behind request for $1000.00 for Airport. The meeting was called to order by Mayor Garrish at 7:30 PM with Councilmen James, Anderson, Beyer and Braun present; also John Hall, Treasurer and Attorney Stewart. The min~s of the previous meetings of~ March 21 and 22 were read and approved. Old Business. Foundations of Buildings - Place on agenda Agenda Attorney Stewart saw Attorney Petre and pointed out that City in no wise acknowledges any liability as to claim by Rob Roy and requested more information as to what Roy is asking. Withhold Roy claim action on bill from McDonald!s Texaco and request for gravel on road. Request for donatio~ to Boy Scouts - Mr. Stewart does not feel that this can be tied in with advertising. Table until approached again. Tab% Maps - still pending. Slim Anderson and Stewart to follow up. Informing public of water stoppage. Take up with Utility Board matter of loud speaker on truck. Cost about $115.OO. Bill James is working with County on dog problem. The County will co-operate with City in maintainiuE road to dump. Fred Braun appointed to work with SnFder on this. Attorney Stewart and Bill James..are working on Rabies Ordinance, and will have it ready by April 18. Question - is aim to be control or revenue? It is control with enough revenue to enforce ordinance. . ~ City bills payable read and discussed. Check insurance coverage on dsmaged bumper on police car. Check lease on sewer bill for Beck and Bishop store. Clerk instructed' to make copy of list of bills payable for each councilman. Motion by Beyer seconded by James, that Rule 19 be suspended and bills paid as read. Unanimously approved. Treasurer's report read ~and accepted upon motion by Anderson seconded by Beyer, Unanimously approved. Don Snyder appeard from Elk's Club, with request that local kids be allowed to take over the City offices for one day. This will be allowed. Continued. Mr. and Mrs. Melman from Denver were introduced. Mayor Garrish said Mr. Melman had been brought in Attorney Melman on recommendation of Judge Shaw to assist Attorney Stewart on East Aspen Patent. Terms of contract East Aspen discussed. Motion made by Anderson, seconded by Beyer - Contract with Mr. Melman to be accepted as Patent specified in letter to M~. Melma~ dated April 4, 1960. Unanimously approved. John Doremus appeared on behalf o2 the Planning and Zoning Commission and said the Commission stron~=ly opposed the decision of the Council with regard to request from Teno Roncallio for Hotel Bulldmno 38 feet in height. He expressed the feelings of the Commission on this matter and quoted from several sources to support their stand. He said they would like to know where they stand. Discussion followed as to economic feasibility, fire hazard, etc. ~ Co%mcilman Anderson suggested that the Comm- ission present recommendations to the CoUncil that might meet legal requirements as well as City requirements from a reasonable standpoint. Councilman James mentioned that Zoning Ooard would like assurance that thei~ recommendations will receive more consideration, and that the protest was made as a matter of principal. John Doremus gave a report on maps and suggested City hold off ordering prints for 2 or three weeks. He also read a letter from Rerbert Bayer regarding large commercial vehicles, and s~gested that space in unrestricted district be used for parking such vekicles. This ma~er is to be turned over to the Zoning Board. The temporary variance granted to Nell Beck is a matter for the Board of Ad- justment. LOu Wille Lou Wille expressed his opinion that vehicles would not have adequate protection if parked far Greenhouse from residence. He also referred to a letter he had received from Building Inspector Markalunas about ~reenhouse he is' buildin$, stating that building permit had been issued about 1955, and that building line had been changed by the recent survey. Discussion followed, and he was advised to take this up with the Board of ~djustment. Darrell Anderson was present and explained to Council the line of paper dispensers he sells. Hold for further discussion. Guido Meyer asked for information re 4 lots - studebaker - in East Aspen. No conflict - claim- ants have received notice to send in money to receive deeds. Attorney is handling. Guido also asked if there is an ordinance covering sale of liquor to those already drunk. Check Ordinance dated 1913. Mr. Stewart recemmended fines be inposed but no jail sentem~e. He will work with Guido on this. Ewing Taylor, representing the Chamber of Cmmerce, repeated cmmplaint previously made about the attitude of a marshal~ and reqsest for street Oiling; also the matter of minor parking violations. Discussion~followed, and he was ~.n~ormed that oiling was under consideration, and other methods of laying dust are being considered. Bill Duo, way said that last year permission had been given to motel owners to put up directional signs, with the understanding that other signs would be taken down, and asked if this had been done. He also asked about Foster Violation and drilling of wells. of Foster Re Foster Violation ? City has received check for $518.92 and' fin~$300.O0 imposed,- $50,00 paid Violation and $250.00 suspended. There are si~ill other violation and if any more occur City will file on each counte Re wells - still pending. Applications for mctel licenses presented - Villa Lamarr Timberline Dorm Glory Hole Motel FlOra Dora Columbine Lodge Bowlby, s MadSen Apartments Motion by Anderson seconded by Beyer , to issue licenses - unanimously approved. Motel InspectOr James reported that Timberline Dorm was rather substandard but that it would not be rented after the winter season. He will follow -%e on this. Mayor Garfish read a letter sent to Tallmadge and Tallmadge by the Utility Board requesting an op~n~on on Ordinance treat~ Utility Board, No. 4 1956. Councilman James read a letter containing an offer to assist in compiling ordinances. Discussion followed. James will follow up. ~lim Anderson will arrange for the printing of 12 maps for sale by City. It Was smggested that if Benboe is handicapped in trash collection by ordinance violation he report -~ hardships to Council. Mayor Garrish announced that there will be a meeting with Dale Rea on Tuesday April 5, at 7:30 PM. Attention of Council was drawn to existing Peddler's and Noise Interference Ordinances. Licensing all businesses - turned over to Planning and Zoning Commission. Washing down streetS - County has sweeper - under consideration. Holes in streets - Anderson is takin~ care of this matter. Sidewalks and planters - excerpts from previous minutes read. (6/20/5~ and 11/3/59) Water and Electric bills in one envelope or on one card. Postmaster Ware is looking further into this. Employees' Group coverage - awaiting further information. Mr. Handy , Auditor's Contract - On agenda.~ Clerk to follow up on bill sent to Aspen Company for help on drain pipe. Weeds and ~rash removal - Ordinance read. Action being formulated. .Mike Garfish ask~ed if there is an ordinance covering moving of survey markers. Mr. Stewart is following up. Counci/man Braun gave. a report on applications h~ had received for job of City Administrator. Clarific ~tion still needed on salary and specific outline of duties. He suggested that these matters be straightened out ~ meet- ing with Utility Board. Clerk to send letter to Les Finley, Water-Co~missioner, Glenwood, to cone to meeting of the Utility Board and Council on April 11. Contract to be antered into with Allan Benboe for his purchasing used lawn' mower from City. Mayor Garr£sh drew attention to the mill le.vy. The City Council of the City of Aspen, Pitkin County, Colorado, met in regular session at the City Ord 2 Hall in said City, the regular meeting place, at the hour of 7:30 PM on the 4th day of April, 1960. 1960 Present Mayor Michael Garfish Water Bonds Councilmen ~. Hall Absent None Thereupon the City Clerk notified the Council that Ordinance No. 2 Series 1960, introdhced, reed Ord. 2 and ordered published at the meeting of. the Council held on~ the 21st day of March, 1960, had been duly 1960 published in the Aspen Times, on the 25th day of March 1960, and pres~ented the publisher's affidavi$ of such publication . Thereupon said Ordinance was again read at length. It was the~ moved by Councilman B~aun and seconded by Councilman James that all rules of this Coun- cil, which, unless susp~ended, might prevent the final passage and adoption of said Ordinance at this meetiz be and the same are hereby suspended. The question being upon the adoption of said motion and the suspension of the ru~. es, the roll was called with the following result: Those voting AYE: Councilmen F.W. Anderson Wolf Beyer Alfred Braun William James Those voting NAT: None. Ail members of the Council havinE voted in favor of said motion, the presiding officer declared said motion carried and rules, suspended. Councilman Braun then moved that said Ordinance be finally passed and adopted aS read. Coun~i]mma Beyer seconded the motion. The question being upon the passage and adoption of said Ordinance, the roll was called with the following result: Those voting AYE: Councilman F, W.
