SPECIAL MEETING PLANNING AND ZONING COMMISSION SEP'l'EMBER 10. 1985
Chairman Welton Anderson called the meeting to order at 5:00
p. m. with Commissioners' Roger Hunt, Al Blonquist, David White,
and Jim Colombo present.

White said the houses in the West End are too big for the lot
size. White did not know what to do about it. Anderson said the
comparison between the small houses that have been torn down and
the new larger houses that are being built is so dramatic that it
may appear worse than it really is. Blonquist said a one sentence
amendment could be made to make a duplex have the same FAR as a
single family residence, the FAR's could be lowered by 10%, and
define area as being an average of 8 feet high. Tom Baker,
planner, said he would discuss the concern with Alan Richman,
Planning Director, and come back to the Commission.

Hunt moved to approve the minutes of July 16, 1985; White seconded.

PUBLIC HEARING
ASPBN AREA COMPRBHBNSIVE PLAN:..
PARKS/RECRBA'l'ION/OPBN SPACBI'rRAILS ELBMENT
Tom Baker, planner, outlined changes suggested by City Council,
County Planning andZ oning Commission, the Board of County
Commissioners, and Craig Ward of the Nordic Council (outlined in
the Planning Office memorandum dated September 10, 1985). Baker
said City Council had adopted a Resolution formally endorsing the
plan with several changes. City Council's suggestions for
changes are outlined in Resolution '85-18.
Hunt said he would like the amended objective .6 on page 12 to say
"as an example, but not limited to" because another example would
be buying a property getting the easement and then sell ing the
unused portion. Baker said he could add that wording. White
said he had attended the Council meeting and mentioned to them
that this Commission was favorable to that thinking. White said
we are looking at how to take open space purchases and start to
categorize them as to which is most important. Hunt asked white
if Council had seemed favorable to the idea. White said it was

not discussed, he had just mentioned it to Council. Hunt suggested
adding the example of buying a piece of property taking the
easement then selling the property to the objective. Hunt's
suggestion was acceptable to all of the members.
Blonquist thought the tourist population should also be defined,
as supplemental, in the changes made to page 19. Further making
the National Standards inappropriate. Baker said he could add a
sentence stating that because of the resort nature of the community
and the influx of business in summer and winter it affects the
facilities. Blonquist suggested adding the statistics to the
Population Comparison chart. Baker said he had looked at the
visitor as not influencing alot in terms of the recreational
facilities but did have an impact on trails. Baker said he did not
want to get too involved in an analysis of the tourist population
just to make the point that is being made here, but would gladly
put in a sentence about the visitors that skew the population
and cause an additional effect on the inadequacy of the National
Standards. White thought Blonquist's point was valid because we
do not have trail heads out of the city and those kind of things
are local and tourist oriented. putting in Blonquist's comment
could change this even more, pointing out the fact that when we do
things for open space and trails we have to think about .1 the
resident, .2 the tourist and how are we serving that tourist or
local. Glen Horn, planner, suggested putting an analysis in,
giving the visitor population in the summer and winter, and then
a discussion of how they use the different facilities.
Blomquist said he would 1 ike to amend the Trail Easement Action
on page 46 to read: "compile a map, on the City Engineers 1 inch
equals 50 foot topographic base map, that shows all city, county,
and other publicly owned property, trail easements, utility
easements, and other easements". This would develop a map that is
exactly the same map that the subdividers will bring in. Anderson
commented that subdividers will bring in what ever is the most
convenient scale for the surveyors, therefore, there will not be
any consistency.
Anderson opened the public hearing. Craig Ward, Nordic Council,
said in his searches for obtaining easements it would have been a
tremendous advantage to know where existing trails and existing
easements were. Mr. Ward said he thought a 1 to 50 scal e map
would be terrific.
Baker moved on to comments made by the County Planning and
Zoning Commission, explaining suggestions for changes made by that

Commission (outlined in Planning Office memorandum dated September
10, 1985). Hunt commented, regarding amendments made to page 11
added condition #17, in the last sentence the wording should
remain "direct" and not be converted to read "straight". Blonquist
suggested striking the entire last sentence. The Commission
agreed with Blonquist's suggestion.
Baker explained that County P&Z had suggested adding condition #8
to page 12 as possibly some community service work that the
courts may assign to traffic violators or high school programs.
Baker said he was also made aware that the Forest Service has
a list of volunteers that wish to come and help maintain Forest
Service property.
Blomquist, in reference to page 26, disagreed that Marolt-Thomas
should be totally passive and did not think all athletics should
be at Iselin Park. Therefore, Blomquist agreed with the suggested
statement from County P&Z and did not bel ieve the statement as
written now was true. Anderson agreed with Blomquist in that
the highway alignment will have an effect on the parcel and the
current statement indicates that it will not. Hunt did not agree
with the suggested statement from County P&Z saying it depends on
what is significant. Hunt said the current statement says it
will be effected, just not significantly effected. The Commission
agreed there would be some effect dependent upon the highway
alignment.
Blonquist thought the paragraph that County P&Z suggested adding
to page 34 should be more specific. He suggested changing the
last sentence of the paragraph to read: "example for also preserving
the Castle Creek and Hunter Creek streambeds, flood ways and
riparian zones". Anderson agreed that it should be more specific
and had no probl em with Blonquist' s wordage. The Commission agreed.
Baker explained the suggestions made by the Board of County
Commissioners (outlined in Planning Office memorandum dated
September 10, 1985). Blomquist said he would like to add something
about bus interface and trail heads to the suggested objective
#18, page 11. Baker thought the change should be made to objective
#10, on page 10, with additional language. Hunt said he thought
the wording "trails manager" should be changed to read "a cognizant
department". White questioned whether objective .10 was specific
enough. Anderson suggested rather than using the wording "public
transit" to use the specific wording "RFTA". Hunt said he preferred
using the gener ic pub 1 ic transit because in the future the
transit system could change. Baker said he could use public

transit and RFTA. Hunt suggested adding a second line saying:
"For example RFTA coordinating with the Parks Department in
determining where bus stops are needed along the trail heads".
The Commission agreed with Hunt's suggestion.
Blomquist thought objective #19, page ll, should be revised to
include "to give title to the City of Aspen for any park/open
space, to give the easement, and build any required trail to
city standards". Anderson said in any subdivision a park dedication
fee is extracted and can be extracted in land or in money, based
on the bedroom count and the value of the property. Anderson
asked Blomquist if he was saying on top of a park dedication fee
that they should be required to give extra land and the price of
making improvements for that land. Blomquist said he would amend
his idea to say within the park dedication fee limits. Baker
commented that by leaving the land in private ownership, as open
space, we have managed to preserve open space without the liability
of maintaining it. In addition, in terms of GMP, it is an easy 3
points if they put the trail in, although it is not required.
Hunt commented that the way objective #19 reads if a new duplex
is condominiumized, as a development under the subdivision regula-
tions, a bike rack will have to be put in front of the duplex.
Hunt said the wording needs to be cleaned up. White agreed with
Hunt and asked that the Planning Office research these matters to
clarify them. Anderson said the matter applies more appropriately
to the Trail Easement or Open Space sections of the plan.
Hunt thought objective #20, page ll, should also include the
wording "where appropriate" at the beginning of the statement.
Anderson asked if the statement referred to public buildings as
in governmental buildings. Baker replied essentially governmental
buildings, where the City has control to put in the bike racks.
Baker suggested, under the Trail section, to add a policy that
reads: "revise the subdivision regulations to require the developer
to construct trails on open space". The Commission agreed.
Baker said there had been concern from Commissioner Blonquist and
Craig Ward of the Nordic Council that there were trails that
should be on the map and are not. Baker outlined the trails on
the map and the changes made. Blomquist made several suggestions
for new trail links. Baker told the Commission he was suggesting
that the changes just outlined be made to the map.

Anderson commented he felt as policy the changes look good and
should be included in the document. Anderson questioned how much
of the proposed change was actually doable and for that reason
thought it may be more appropriate as an appendix. White thought
an appendix was a good idea. Blomquist said the subdivision
ordinance says if there is a trail on the trails master plan then
the developer shall dedicate the right-of-way for that trail.
Blonquist commented that the reverse of that is also true in that
if the trail is not shown the developer has no obligation to
provide a trail. By adopting this plan without all of these
easements and trails, already obtained, outlined we are saying we
no longer need them and have actually transferred a property
right. Therefore, we should be very clear about what we are
talking about. By adopting this we have taken a legal action
that destroys the effectiveness of the subdivision.
Baker commented that many of the additions to the trails map
are changes in alignment, on public property, and those to the
east are a change in the neighborhood plan. Baker also commented
that master plans are supposed to be general in nature, to guide
the trail easements. Blonquist suggested amending the resolution,
in the second 1 ine of Be It Further Resolved, changing the word
"supercede" to "supplement" to add a comma at the end of the
sentence adding "and that the staff merge said plans on the City
Engineers map and present same to this Commission for adoption as
part of the pending official City plan". By doing this we have
adopted the plan and said it w ill be redrawn when further in to
the process of land use, transportation, and the other elements.
By adopting this as a supplement to the existing trails master
plan everything is covered. Hunt said he liked the idea of
adding the map as a supplement to the plan, communicating this is
the direction we are going. White agreed.
Motion:
Hunt moved to adopt Resolution #85-19 as amended including
wording in the trails section which deals with responsibility of
land acquisition and construction and including the trails map
submitted September 10, 1985 as an appendix to the plan, White
seconded.
Discussion:
Hunt thought it should be indicated that the detail on the plans
submi tted are subject to change pending other determinations on
other elements. Blomquist suggested adding "Be it Further

Resolved that this is one element in the Aspen Area Comprehensive
Plan; details of which can/w ill change as other elements are
developed". Anderson said he thought the statement should be
added at the end of the current Be it Further Resolved statement.
Hunt and White agreed to amend their motion.

Anderson adjourned the meeting at 7:03 p.m.
